Dok politolog Goran Čular smatra da ne treba dirati Zakon o izborima, protivi se, kaže, zabranama i negiranju pasivnog biračkog prava, ali zagovara otvorenost i transparentnost.

Kandidati bi, naglašava, morali jasno deklarirati svoje ciljeve, birači moraju znati njihove namjere i biti svjesni da kandidat možda neće preuzeti mandat u Saboru, a na biračima je da odluče prihvaćaju li takvu ponudu i smatraju li da je u redu da stranku predstavlja neka poznata osoba, premda ne želi sjediti u Saboru.

Profesori Žarko Puhovski i Ivan Rimac pak zagovaraju da se Zakon mijenja, i to temeljito. Puhovski vjeruje da neće biti promjena sve dok se ne pooštre uvjeti kandidiranja.

"Zakon bi trebalo postaviti tako da se ne može kandidirati nitko tko ne može prihvatiti mandat. Nek‘ izvole dati ostavku ako hoće, ali sve drugo je potpuno nemoralno i loše za sustav", naglašava Puhovski, piše Jutarnji list.

Mogućnost varanja

Profesor sa zagrebačkog Pravnog fakulteta Ivan Rimac dio anomalija i spornih praksi pripisuje tome što su parlamentarni izbori kod nas izbori stranaka, a ne pojedinaca.

"Uvođenje preferencijskoga glasanja bio je pokušaj korektiva toga da stranke potpuno određuju tko ulazi u Sabor honoriranjem popularnosti konkretnih osoba. Međutim, to je rezultiralo dvjema stvarima: ignoriranjem preferencijskoga glasanja tako da se onaj koji je izabran svejedno odrekne mandata.

I drugo, volatilnosti izbornoga postupka; onaj tko ne zaokruži preferiranog zastupnika na listi na izborima otvara mogućnost jednostavnog varanja tako da netko poslije zaokruži nekog preferiranog zastupnika s neke druge liste i da se taj listić poništi. To nije dobro i primjereno rješenje", naglašava Rimac.

Rimac podsjeća na drugačije izborne sustave, primjerice, britanski koji bira stranke u parlamentu, ali ima vrlo jasno određene izborne okruge u kojima se zastupnici biraju imenom i prezimenom, kucaju na vrata budućim glasačima i predstavljaju se likom na kućnim vratima, a stranka je tu samo legitimacija grupacije poslije u parlamentu. Taj sustav je uglavnom binaran, ima samo dvije stranke.

"Naš izborni sustav ne dopušta čak ni jasan izborni i postizborni program za područje na kojemu se biraju", upozorava Rimac i tumači: "Od Knina do Kutine imamo raznorodne dijelove koji imaju različite probleme i potencijale razvoja, njima ne možete ponuditi zajednički program.

Svođenje izbornih jedinica na postojeće jedinice lokalne samouprave bilo bi bitno drugačije zbog toga što bi se vrlo jasno znalo kome se kandidati obraćaju, ‘natjeralo‘ bi ih da se bave jasnim temama i na kraju krajeva oni koji za njih glasaju imali bi ih pravo pitati što su napravili.

Nakaradan sustav

Mi smo u situaciji da biramo nekoga tko sutra može ležati u Saboru ili se ne pojavljivati, kao što je to radio Željko Kerum, a da nikome nije odgovoran. Jedina odgovornost sastoji se u tome da digne ruku kada mu to naredi partijska vrhuška ako je dio vladajuće većine. A ako nije, ne mora niti to."

Takav je sustav, smatra Rimac, nakaradan i treba ga mijenjati, počevši od toga da se diskvalificiraju liste koje nisu poštovale ženske kvote.

"Tako bi se stranke prisililo na poštivanje Zakona. Očito je da dominantna većina u političkom miljeu takvo što ne želi, isto kao što ne žele izglasati neke druge stvari vezane uz Zakon o izborima. Zato i imamo neke besprizorne kandidate koji su ili pod istragom ili prijetnjom tužbi, ili su se osramotili diskriminirajući pojedine skupine ljudi tako da ih nitko živ ne bi trebao prihvatiti.

Ne samo što je Mislav Kolakušić istrgovao prvo mjesto na listi nego su i on i Ivan Vilibor Sinčić u Europskom parlamentu bili ruglo za Hrvatsku i po neaktivnosti i po aktivnosti koju su provodili. Neodgovornost zastupnika na nacionalnoj razini sada se proširila i na Parlament Europske unije zbog toga što praktički nema obaveze da se biračima na kraju mandata podnose računi", kaže profesor sa zagrebačkog Pravnog fakulteta Ivan Rimac.

Dok politolog Goran Čular smatra da ne treba dirati Zakon o izborima, protivi se, kaže, zabranama i negiranju pasivnog biračkog prava, ali zagovara otvorenost i transparentnost.

Kandidati bi, naglašava, morali jasno deklarirati svoje ciljeve, birači moraju znati njihove namjere i biti svjesni da kandidat možda neće preuzeti mandat u Saboru, a na biračima je da odluče prihvaćaju li takvu ponudu i smatraju li da je u redu da stranku predstavlja neka poznata osoba, premda ne želi sjediti u Saboru.

Profesori Žarko Puhovski i Ivan Rimac pak zagovaraju da se Zakon mijenja, i to temeljito. Puhovski vjeruje da neće biti promjena sve dok se ne pooštre uvjeti kandidiranja.

"Zakon bi trebalo postaviti tako da se ne može kandidirati nitko tko ne može prihvatiti mandat. Nek‘ izvole dati ostavku ako hoće, ali sve drugo je potpuno nemoralno i loše za sustav", naglašava Puhovski, piše Jutarnji list.

Mogućnost varanja

Profesor sa zagrebačkog Pravnog fakulteta Ivan Rimac dio anomalija i spornih praksi pripisuje tome što su parlamentarni izbori kod nas izbori stranaka, a ne pojedinaca.

"Uvođenje preferencijskoga glasanja bio je pokušaj korektiva toga da stranke potpuno određuju tko ulazi u Sabor honoriranjem popularnosti konkretnih osoba. Međutim, to je rezultiralo dvjema stvarima: ignoriranjem preferencijskoga glasanja tako da se onaj koji je izabran svejedno odrekne mandata.

I drugo, volatilnosti izbornoga postupka; onaj tko ne zaokruži preferiranog zastupnika na listi na izborima otvara mogućnost jednostavnog varanja tako da netko poslije zaokruži nekog preferiranog zastupnika s neke druge liste i da se taj listić poništi. To nije dobro i primjereno rješenje", naglašava Rimac.

Rimac podsjeća na drugačije izborne sustave, primjerice, britanski koji bira stranke u parlamentu, ali ima vrlo jasno određene izborne okruge u kojima se zastupnici biraju imenom i prezimenom, kucaju na vrata budućim glasačima i predstavljaju se likom na kućnim vratima, a stranka je tu samo legitimacija grupacije poslije u parlamentu. Taj sustav je uglavnom binaran, ima samo dvije stranke.

"Naš izborni sustav ne dopušta čak ni jasan izborni i postizborni program za područje na kojemu se biraju", upozorava Rimac i tumači: "Od Knina do Kutine imamo raznorodne dijelove koji imaju različite probleme i potencijale razvoja, njima ne možete ponuditi zajednički program.

Svođenje izbornih jedinica na postojeće jedinice lokalne samouprave bilo bi bitno drugačije zbog toga što bi se vrlo jasno znalo kome se kandidati obraćaju, ‘natjeralo‘ bi ih da se bave jasnim temama i na kraju krajeva oni koji za njih glasaju imali bi ih pravo pitati što su napravili.

Nakaradan sustav

Mi smo u situaciji da biramo nekoga tko sutra može ležati u Saboru ili se ne pojavljivati, kao što je to radio Željko Kerum, a da nikome nije odgovoran. Jedina odgovornost sastoji se u tome da digne ruku kada mu to naredi partijska vrhuška ako je dio vladajuće većine. A ako nije, ne mora niti to."

Takav je sustav, smatra Rimac, nakaradan i treba ga mijenjati, počevši od toga da se diskvalificiraju liste koje nisu poštovale ženske kvote.

"Tako bi se stranke prisililo na poštivanje Zakona. Očito je da dominantna većina u političkom miljeu takvo što ne želi, isto kao što ne žele izglasati neke druge stvari vezane uz Zakon o izborima. Zato i imamo neke besprizorne kandidate koji su ili pod istragom ili prijetnjom tužbi, ili su se osramotili diskriminirajući pojedine skupine ljudi tako da ih nitko živ ne bi trebao prihvatiti.

Ne samo što je Mislav Kolakušić istrgovao prvo mjesto na listi nego su i on i Ivan Vilibor Sinčić u Europskom parlamentu bili ruglo za Hrvatsku i po neaktivnosti i po aktivnosti koju su provodili. Neodgovornost zastupnika na nacionalnoj razini sada se proširila i na Parlament Europske unije zbog toga što praktički nema obaveze da se biračima na kraju mandata podnose računi", kaže profesor sa zagrebačkog Pravnog fakulteta Ivan Rimac.
