Je li predsjednik Republike prekršio Ustav pokušavajući utjecati na ishod glasanja saborskih zastupnika (Pupovca i Kajtazija), odnosno koliko je sporno što je Miloradu Pupovcu prijetio USKOK-om, Jutarnji list je razgovarao s ustavnopravnim stručnjacima. Po mišljenju Branka Smerdela, predsjednik RH se neformalno može konzultirati s kim god hoće. Ono što ne smije jest vrijeđati i prijetiti.

- Prijetnje, uvrede i podvale su na razini primitivne politike. Time što je prijetio USKOK-om, nije prekršio Ustav, ali je ova situacija na rubu Kaznenog zakona, kao uvreda ili kleveta. Slanje poslanica Saboru je 2000. godine odbačeno, jer nije u skladu s načelom diobe vlasti. No cijeli politički proces se ionako odvija neformalno i odluke se često donose potajno - navodi Smerdel.

Ono što izuzetno zamjera Milanoviću jest što je sklon reći: Istina je da to piše u Ustavu ili zakonu, no ja to neću dozvoliti.

- To je prvi put napravio 2013., kad su građani počeli skupljati potpise za referendum, pa je kao premijer rekao da to neće dozvoliti. Meni je u subotu poručio kako me izabrao HDZ, što je potpuno netočno - kaže Branko Smerdel za Jutarnji.

Udar na ustavni poredak

Za Matu Palića, ustavnog stručnjaka s Pravnog fakulteta u Osijeku, nema nikakve dvojbe da je predsjednik svojim pokušajem utjecaja na saborske zastupnike Pupovca i Kajtazija prekršio Ustav. I to, tvrdi, već drugi put u kratkom vremenu.

- Prvi put je Ustav prekršio kad je Saboru, protivno Zakonu o sudovima, dao svoj prijedlog oko profesorice Zlate Đurđević, iako je Ustavni sud jasno verificirao da se za predsjednika Vrhovnoga suda može predložiti osoba koja se javila. Ovo sad je drugo kršenje Ustava i teško narušavanje načela diobe vlasti. Sad je odgovornost na zastupnicima u Saboru da reagiraju na činjenicu da predsjednik države opetovano krši Ustav i da pokrenu postupak njegova opoziva. Jer mi više doista ne znamo što možemo očekivati od predsjednika - komentira Palić.

Pogrešna taktika

Smatra kako predsjednikova prijetnja Pupovcu USKOK-om ulazi u zonu kaznenopravne odgovornosti.

- Tu je državno odvjetništvo dužno provesti radnje i obaviti razgovore - kaže Mato Palić.

Sanja Barić, predstojnica Katedre za ustavno pravo riječkog Pravnog fakulteta, ne smatra da je ovdje prvenstveno riječ o pravnome pitanju, nego o potpuno pogrešnoj političkoj taktici ostvarivanja onoga što je predsjednik zamislio, a to je predlaganje najkvalitetnijeg kandidata odnosno kandidatkinje i uspjeh u izboru tog kandidata. Taktika koju je predsjednik odabrao je kriva jer se njome ne dolazi do cilja.

- Onaj tko zna igrati igru, a predsjednik i saborski zastupnici bi to trebali znati jer su tu dugo prisutni, ne bi trebao odabrati strategiju s iznimno malom vjerojatnošću uspjeha. Jasno da svi želimo bolje sudstvo i kvalitetnog predsjednika Vrhovnog suda, ali strategija koju je predsjednik odabrao za ostvarenje toga cilja od starta je bila osuđena na propast. Ne smijemo zaboraviti da predsjednik RH ima ovlasti kojima pravnim putem može doprinijeti razotkrivanju afera i mafijaške skupine unutar sudstva - kaže Sanja Barić.

Ako Milanović želi raditi prave stvari, a ne stvarati političku maglu, na raspolaganju ima tajne službe, napominje.

- Raskrinkavanje je moglo početi odozgo ili odozdo, kroz Odvjetničku komoru i udruge sudaca. To bi dovelo do rješenja, no činjenica je da oni koji imaju ovlasti i mehanizme za raščišćavanje ili te mehanizme ne žele pokrenuti ili se boje - zaključuje Sanja Barić.

Je li predsjednik Republike prekršio Ustav pokušavajući utjecati na ishod glasanja saborskih zastupnika (Pupovca i Kajtazija), odnosno koliko je sporno što je Miloradu Pupovcu prijetio USKOK-om, Jutarnji list je razgovarao s ustavnopravnim stručnjacima. Po mišljenju Branka Smerdela, predsjednik RH se neformalno može konzultirati s kim god hoće. Ono što ne smije jest vrijeđati i prijetiti.

- Prijetnje, uvrede i podvale su na razini primitivne politike. Time što je prijetio USKOK-om, nije prekršio Ustav, ali je ova situacija na rubu Kaznenog zakona, kao uvreda ili kleveta. Slanje poslanica Saboru je 2000. godine odbačeno, jer nije u skladu s načelom diobe vlasti. No cijeli politički proces se ionako odvija neformalno i odluke se često donose potajno - navodi Smerdel.

Ono što izuzetno zamjera Milanoviću jest što je sklon reći: Istina je da to piše u Ustavu ili zakonu, no ja to neću dozvoliti.

- To je prvi put napravio 2013., kad su građani počeli skupljati potpise za referendum, pa je kao premijer rekao da to neće dozvoliti. Meni je u subotu poručio kako me izabrao HDZ, što je potpuno netočno - kaže Branko Smerdel za Jutarnji.

Udar na ustavni poredak

Za Matu Palića, ustavnog stručnjaka s Pravnog fakulteta u Osijeku, nema nikakve dvojbe da je predsjednik svojim pokušajem utjecaja na saborske zastupnike Pupovca i Kajtazija prekršio Ustav. I to, tvrdi, već drugi put u kratkom vremenu.

- Prvi put je Ustav prekršio kad je Saboru, protivno Zakonu o sudovima, dao svoj prijedlog oko profesorice Zlate Đurđević, iako je Ustavni sud jasno verificirao da se za predsjednika Vrhovnoga suda može predložiti osoba koja se javila. Ovo sad je drugo kršenje Ustava i teško narušavanje načela diobe vlasti. Sad je odgovornost na zastupnicima u Saboru da reagiraju na činjenicu da predsjednik države opetovano krši Ustav i da pokrenu postupak njegova opoziva. Jer mi više doista ne znamo što možemo očekivati od predsjednika - komentira Palić.

Pogrešna taktika

Smatra kako predsjednikova prijetnja Pupovcu USKOK-om ulazi u zonu kaznenopravne odgovornosti.

- Tu je državno odvjetništvo dužno provesti radnje i obaviti razgovore - kaže Mato Palić.

Sanja Barić, predstojnica Katedre za ustavno pravo riječkog Pravnog fakulteta, ne smatra da je ovdje prvenstveno riječ o pravnome pitanju, nego o potpuno pogrešnoj političkoj taktici ostvarivanja onoga što je predsjednik zamislio, a to je predlaganje najkvalitetnijeg kandidata odnosno kandidatkinje i uspjeh u izboru tog kandidata. Taktika koju je predsjednik odabrao je kriva jer se njome ne dolazi do cilja.

- Onaj tko zna igrati igru, a predsjednik i saborski zastupnici bi to trebali znati jer su tu dugo prisutni, ne bi trebao odabrati strategiju s iznimno malom vjerojatnošću uspjeha. Jasno da svi želimo bolje sudstvo i kvalitetnog predsjednika Vrhovnog suda, ali strategija koju je predsjednik odabrao za ostvarenje toga cilja od starta je bila osuđena na propast. Ne smijemo zaboraviti da predsjednik RH ima ovlasti kojima pravnim putem može doprinijeti razotkrivanju afera i mafijaške skupine unutar sudstva - kaže Sanja Barić.

Ako Milanović želi raditi prave stvari, a ne stvarati političku maglu, na raspolaganju ima tajne službe, napominje.

- Raskrinkavanje je moglo početi odozgo ili odozdo, kroz Odvjetničku komoru i udruge sudaca. To bi dovelo do rješenja, no činjenica je da oni koji imaju ovlasti i mehanizme za raščišćavanje ili te mehanizme ne žele pokrenuti ili se boje - zaključuje Sanja Barić.

Je li predsjednik Republike prekršio Ustav pokušavajući utjecati na ishod glasanja saborskih zastupnika (Pupovca i Kajtazija), odnosno koliko je sporno što je Miloradu Pupovcu prijetio USKOK-om, Jutarnji list je razgovarao s ustavnopravnim stručnjacima. Po mišljenju Branka Smerdela, predsjednik RH se neformalno može konzultirati s kim god hoće. Ono što ne smije jest vrijeđati i prijetiti.

- Prijetnje, uvrede i podvale su na razini primitivne politike. Time što je prijetio USKOK-om, nije prekršio Ustav, ali je ova situacija na rubu Kaznenog zakona, kao uvreda ili kleveta. Slanje poslanica Saboru je 2000. godine odbačeno, jer nije u skladu s načelom diobe vlasti. No cijeli politički proces se ionako odvija neformalno i odluke se često donose potajno - navodi Smerdel.
