- Izjave Hrvatske udruge banaka teška su manipulacija istinom. Istina jest da je izračun konverzije rađen tako da se od naplaćenih iznosa oduzimalo iznose po simuliranom euro kreditu ne bi li se tako došlo do novih umanjenih glavnica. Međutim, konverzije su rađene u vrijeme kada nije bila još uvijek utvrđena ništetnost valutne klauzule CHF. Potrošači se konverzijom nisu odrekli svojih potraživanja u budućnosti, niti je konverzijom izvršena konvalidacija ništetnih ugovornih odredaba od početka ugovornog odnosa, već je tek od dana konverzije CHF zamijenjen eurom te je ugovorena nova kamatna stopa – ističe Goran Aleksić, koordinator ekonomsko-pravnog tima Udruge Franak.

Aleksić pojašnjava kako su utvrđenjem ništetnosti valutne klauzule CHF potrošači dobili pravo da se izuzećem tih odredaba utvrdi veličina njihova obeštećenja. Zbog toga, iznosi preplaćenog tečaja i preplaćenih kamata ne mogu biti korišteni za potrebe banke, jer oni pripadaju potrošačima. Osim toga, glavnice se po sili kolektivne presude moraju pretvoriti u kunske, a ne u euro glavnice, u skladu s početnim otplatnim planom u kunama bez rasta tečaja i bez rasta kamate.

- Potrošači s konverzijama, ponavljam još jednom, nisu dobili umanjenje glavnice izuzećem ništetnih odredaba jer je konvertirana glavnica veća od takve glavnice za 10% do 15%, nisu dobili preplaćene iznose kamata i tečaja, i nisu dobili pripadajuće zatezne kamate. Potrošači s konverzijama uspoređuju se s potrošačima iz CHF kredita koji NISU konvertirali kredite, ali su dobili obeštećenja. Usporedbom s takvim potrošačima dolazimo do matematičkog zaključka da potrošači bez konverzija i s obeštećenjem do kraja otplate kredita plaćaju ukupno 40% do 50% manje iznosa u anuitetima od potrošača s konverzijama koji ne bi imali pravo na obeštećenje. To je klasični oblik diskriminacije i kršenja ljudskih prava, a osim toga je to suprotno presudama Suda EU C-118/17 i C-260/18 kojima je nedvojbeno izrečeno da potrošači imaju pravo na punu restituciju, ako konverzijom nisu obeštećeni – naglašava Aleksić.

Dodaje kako u Udruzi Franak zaključuju da odgovor na pitanje o pravu potrošača nakon konverzije nisu dobili, da će suci i dalje donositi različite sudske odluke, i da Vrhovni sud i dalje nije ispunio svoju zadaću ujednačavanja sudske prakse.

- To je sramota sudaca Vrhovnog suda, koju mogu sprati samo hitnim sazivanjem nove sjednice, i odlučivanjem o meritumu, a ne o nečemu čega u tužbama nema. Dotad, tužitelji moraju biti svjesni da pravne sigurnosti za njih i dalje nema, i da će se možda pitanje naših prava riješiti tek na Ustavnom sudu. Naglašavam i to da pravno shvaćanje koje je objavljeno zajedno s neusvojenim shvaćanjima nije prošlo sudsku evidenciju, pa nije isključeno da će sve to na kraju biti potpuno bezvrijedno - ističe Aleksić.

- Izjave Hrvatske udruge banaka teška su manipulacija istinom. Istina jest da je izračun konverzije rađen tako da se od naplaćenih iznosa oduzimalo iznose po simuliranom euro kreditu ne bi li se tako došlo do novih umanjenih glavnica. Međutim, konverzije su rađene u vrijeme kada nije bila još uvijek utvrđena ništetnost valutne klauzule CHF. Potrošači se konverzijom nisu odrekli svojih potraživanja u budućnosti, niti je konverzijom izvršena konvalidacija ništetnih ugovornih odredaba od početka ugovornog odnosa, već je tek od dana konverzije CHF zamijenjen eurom te je ugovorena nova kamatna stopa – ističe Goran Aleksić, koordinator ekonomsko-pravnog tima Udruge Franak.

Aleksić pojašnjava kako su utvrđenjem ništetnosti valutne klauzule CHF potrošači dobili pravo da se izuzećem tih odredaba utvrdi veličina njihova obeštećenja. Zbog toga, iznosi preplaćenog tečaja i preplaćenih kamata ne mogu biti korišteni za potrebe banke, jer oni pripadaju potrošačima. Osim toga, glavnice se po sili kolektivne presude moraju pretvoriti u kunske, a ne u euro glavnice, u skladu s početnim otplatnim planom u kunama bez rasta tečaja i bez rasta kamate.

- Potrošači s konverzijama, ponavljam još jednom, nisu dobili umanjenje glavnice izuzećem ništetnih odredaba jer je konvertirana glavnica veća od takve glavnice za 10% do 15%, nisu dobili preplaćene iznose kamata i tečaja, i nisu dobili pripadajuće zatezne kamate. Potrošači s konverzijama uspoređuju se s potrošačima iz CHF kredita koji NISU konvertirali kredite, ali su dobili obeštećenja. Usporedbom s takvim potrošačima dolazimo do matematičkog zaključka da potrošači bez konverzija i s obeštećenjem do kraja otplate kredita plaćaju ukupno 40% do 50% manje iznosa u anuitetima od potrošača s konverzijama koji ne bi imali pravo na obeštećenje. To je klasični oblik diskriminacije i kršenja ljudskih prava, a osim toga je to suprotno presudama Suda EU C-118/17 i C-260/18 kojima je nedvojbeno izrečeno da potrošači imaju pravo na punu restituciju, ako konverzijom nisu obeštećeni – naglašava Aleksić.

Dodaje kako u Udruzi Franak zaključuju da odgovor na pitanje o pravu potrošača nakon konverzije nisu dobili, da će suci i dalje donositi različite sudske odluke, i da Vrhovni sud i dalje nije ispunio svoju zadaću ujednačavanja sudske prakse.

- To je sramota sudaca Vrhovnog suda, koju mogu sprati samo hitnim sazivanjem nove sjednice, i odlučivanjem o meritumu, a ne o nečemu čega u tužbama nema. Dotad, tužitelji moraju biti svjesni da pravne sigurnosti za njih i dalje nema, i da će se možda pitanje naših prava riješiti tek na Ustavnom sudu. Naglašavam i to da pravno shvaćanje koje je objavljeno zajedno s neusvojenim shvaćanjima nije prošlo sudsku evidenciju, pa nije isključeno da će sve to na kraju biti potpuno bezvrijedno - ističe Aleksić.

- Izjave Hrvatske udruge banaka teška su manipulacija istinom. Istina jest da je izračun konverzije rađen tako da se od naplaćenih iznosa oduzimalo iznose po simuliranom euro kreditu ne bi li se tako došlo do novih umanjenih glavnica. Međutim, konverzije su rađene u vrijeme kada nije bila još uvijek utvrđena ništetnost valutne klauzule CHF. Potrošači se konverzijom nisu odrekli svojih potraživanja u budućnosti, niti je konverzijom izvršena konvalidacija ništetnih ugovornih odredaba od početka ugovornog odnosa, već je tek od dana konverzije CHF zamijenjen eurom te je ugovorena nova kamatna stopa – ističe Goran Aleksić, koordinator ekonomsko-pravnog tima Udruge Franak.
