Vrhovni sud odbio je žalbu Željka Melvana, 38-godišnjaka koji se nalazi u istražnom zatvoru u Zagrebu zbog optužbe da je nožem ubio Vedrana Marendića (53), zvanog Sarun, a koju je podnio njegov odvjetnik Toni Marinković.

U žalbi su tražili da se kao nezakoniti dokazi izdvoje potvrda KBC-a Split o predaji odjeće, obuće i narukvica pokojnog Saruna policiji te biološko i daktiloskopsko vještačenje koje je proveo MUP-ov Centar “Ivan Vučetić”. Iako u žalbi nije obrazloženo zašto bi prva dva dokaza bila nezakonita, Vrhovni je sud odlučio da se oni mogu koristiti u dokaznom postupku jer nisu pribavljeni nikakvim nelegalnim i nezakonitim putem.

Što se tiče, pak, biološkog vještačenja koje je obavio MUP-ov centar, Melvanov je odvjetnik ustvrdio da se ono nije moglo obaviti jer je DNK uzorak koji je korišten trebao biti uništen i nije ga se smjelo upotrebljavati. DNK uzorak uzet je od Melvana još 3. ožujka 2014. godine, i to na osnovi naloga ODO-a Šibenik koji je istraživao Melvanovu umiješanost u tešku krađu. Uzorak je tada pohranjen u evidenciju DNK osumnjičenih i osuđenih osoba sukladno tad važećem Pravilniku o načinu uzimanja uzoraka biološkog materijala za analizu DNK.

Novi Pravilnik

Sredinom listopada 2014. godine na snagu je stupio novi Pravilnik kojim je, među ostalim, propisano da se podaci koji su prikupljeni uzimanjem uzorka od osumnjičenika koji poslije nije pravomoćno osuđen čuvaju deset godina od završetka postupka i da se nakon toga brišu.

– Imajući u vidu da je biološki uzorak žalitelja izuzet od njega temeljem naloga državnog odvjetnika od 3. ožujka 2014. godine, a podatak pribavljen molekularno-genetskom analizom provedenom po nalogu od 17. ožujka 2014., to nije u pravu žalitelj kada tvrdi da je njegov uzorak, odnosno podatak pribavljen analizom uzorka, trebao biti uništen i brisan iz baze podataka Centra “Ivan Vučetić” – navodi se, među ostalim, u odluci Vrhovnog suda, koji napominje kako “upiranje na starost uzorka kojim se zapravo insinuira na njegovu neuporabljivost, nije od utjecaja na odluku o zakonitosti dokaza”.

Melvan je optužen da je 26. lipnja lani, u centru Splita u Sinjskoj ulici, tijekom prepirke više puta udario Marendića po glavi, nožem mu odrezao pramen kose i pljunuo ga, a onda je istim nožem duljine oštrice 20 centimetara ubo Marendića u desni kuk, u desnu natkoljenicu i u desnu stranu prsnog koša. Nakon toga je pobjegao, a Sarun je od posljedica teških ozljeda preminuo u splitskoj bolnici dva dana poslije. Sukob se navodno dogodio zbog tri tisuće kuna koje je Marendić dugovao Melvanu.

Uhićen na pumpi

Melvan je uhićen u Kninu, na benzinskoj crpki, početkom siječnja ove godine.

U optužnici ŽDO-a stoji, među ostalim, da iz biološkog vještačenja proizlazi kako je na oštrici noža (koji su pronaši građani četiri dana nakon događaja) pronađen trag krvi koji se podudara s DNK profilom žrtve. DNK nađen na dršci noža nije se mogao analizirati jer ga nije bilo dovoljno.

– Analizom brisa pivske boce, brisa pramena kose, brisa narukvica skinutih s ruke žrtve utvrđen je DNK profil okrivljenika Željka Melvana. Analizom tragova krvi s tenisica žrtve utvrđen je miješani DNK profil u kojem se dio podudara s DNK profilom žrtve, a dio se podudara s DNK profilom okrivljenika. Daktiloskopskim vještačenjem staklene boce, sunčanih naočala i noža utvrđeno je kako izazvani tragovi papilamih linija nisu upotrebljivi u svrhu identifikacije – navodi se u optužnici.

Vrhovni sud odbio je žalbu Željka Melvana, 38-godišnjaka koji se nalazi u istražnom zatvoru u Zagrebu zbog optužbe da je nožem ubio Vedrana Marendića (53), zvanog Sarun, a koju je podnio njegov odvjetnik Toni Marinković.

U žalbi su tražili da se kao nezakoniti dokazi izdvoje potvrda KBC-a Split o predaji odjeće, obuće i narukvica pokojnog Saruna policiji te biološko i daktiloskopsko vještačenje koje je proveo MUP-ov Centar “Ivan Vučetić”. Iako u žalbi nije obrazloženo zašto bi prva dva dokaza bila nezakonita, Vrhovni je sud odlučio da se oni mogu koristiti u dokaznom postupku jer nisu pribavljeni nikakvim nelegalnim i nezakonitim putem.

Što se tiče, pak, biološkog vještačenja koje je obavio MUP-ov centar, Melvanov je odvjetnik ustvrdio da se ono nije moglo obaviti jer je DNK uzorak koji je korišten trebao biti uništen i nije ga se smjelo upotrebljavati. DNK uzorak uzet je od Melvana još 3. ožujka 2014. godine, i to na osnovi naloga ODO-a Šibenik koji je istraživao Melvanovu umiješanost u tešku krađu. Uzorak je tada pohranjen u evidenciju DNK osumnjičenih i osuđenih osoba sukladno tad važećem Pravilniku o načinu uzimanja uzoraka biološkog materijala za analizu DNK.

Novi Pravilnik

Sredinom listopada 2014. godine na snagu je stupio novi Pravilnik kojim je, među ostalim, propisano da se podaci koji su prikupljeni uzimanjem uzorka od osumnjičenika koji poslije nije pravomoćno osuđen čuvaju deset godina od završetka postupka i da se nakon toga brišu.

– Imajući u vidu da je biološki uzorak žalitelja izuzet od njega temeljem naloga državnog odvjetnika od 3. ožujka 2014. godine, a podatak pribavljen molekularno-genetskom analizom provedenom po nalogu od 17. ožujka 2014., to nije u pravu žalitelj kada tvrdi da je njegov uzorak, odnosno podatak pribavljen analizom uzorka, trebao biti uništen i brisan iz baze podataka Centra “Ivan Vučetić” – navodi se, među ostalim, u odluci Vrhovnog suda, koji napominje kako “upiranje na starost uzorka kojim se zapravo insinuira na njegovu neuporabljivost, nije od utjecaja na odluku o zakonitosti dokaza”.

Melvan je optužen da je 26. lipnja lani, u centru Splita u Sinjskoj ulici, tijekom prepirke više puta udario Marendića po glavi, nožem mu odrezao pramen kose i pljunuo ga, a onda je istim nožem duljine oštrice 20 centimetara ubo Marendića u desni kuk, u desnu natkoljenicu i u desnu stranu prsnog koša. Nakon toga je pobjegao, a Sarun je od posljedica teških ozljeda preminuo u splitskoj bolnici dva dana poslije. Sukob se navodno dogodio zbog tri tisuće kuna koje je Marendić dugovao Melvanu.

Uhićen na pumpi

Melvan je uhićen u Kninu, na benzinskoj crpki, početkom siječnja ove godine.

U optužnici ŽDO-a stoji, među ostalim, da iz biološkog vještačenja proizlazi kako je na oštrici noža (koji su pronaši građani četiri dana nakon događaja) pronađen trag krvi koji se podudara s DNK profilom žrtve. DNK nađen na dršci noža nije se mogao analizirati jer ga nije bilo dovoljno.

– Analizom brisa pivske boce, brisa pramena kose, brisa narukvica skinutih s ruke žrtve utvrđen je DNK profil okrivljenika Željka Melvana. Analizom tragova krvi s tenisica žrtve utvrđen je miješani DNK profil u kojem se dio podudara s DNK profilom žrtve, a dio se podudara s DNK profilom okrivljenika. Daktiloskopskim vještačenjem staklene boce, sunčanih naočala i noža utvrđeno je kako izazvani tragovi papilamih linija nisu upotrebljivi u svrhu identifikacije – navodi se u optužnici.

Zločin u centru Splita: Vrhovni sud odlučio da Melvanov DNK vrijedi kao dokaz

Vrhovni sud odbio je žalbu Željka Melvana, 38-godišnjaka koji se nalazi u istražnom zatvoru u Zagrebu zbog optužbe da je nožem ubio Vedrana Marendića (53), zvanog Sarun, a koju je podnio njegov odvjetnik Toni Marinković.

U žalbi su tražili da se kao nezakoniti dokazi izdvoje potvrda KBC-a Split o predaji odjeće, obuće i narukvica pokojnog Saruna policiji te biološko i daktiloskopsko vještačenje koje je proveo MUP-ov Centar “Ivan Vučetić”. Iako u žalbi nije obrazloženo zašto bi prva dva dokaza bila nezakonita, Vrhovni je sud odlučio da se oni mogu koristiti u dokaznom postupku jer nisu pribavljeni nikakvim nelegalnim i nezakonitim putem.

Što se tiče, pak, biološkog vještačenja koje je obavio MUP-ov centar, Melvanov je odvjetnik ustvrdio da se ono nije moglo obaviti...
