Prilikom izgradnje novih potpornih zidova iznad uvale Ježinac na Marjanu nije počinjeno kazneno djelo, zaključeno je na Općinskom državnom odvjetništvu u Splitu. Navedenim rješenjem su odbačene kaznene prijave Javne ustanove za upravljanje Park-šumom Marjan i Društva za zaštitu i unaprjeđenje Marjana protiv investitorice Tereze Žderić, vlasnice parcele s kamenom kućom i zelenim perivojem koja se spušta do šetnice uz more.

Prijave su podnijete zbog sumnje da je počinila kazneno djelo protupravne gradnje unutar zaštićenog dijela prirode i unutar kulturno-povijesne cjeline Meje, na lokaciji Meštrovićevo šetalište 31, u Park-šumi Marjan. Međutim, radovi su odobreni sukladno Pravilniku o jednostavnim i drugim građevinama i radovima bez građevinske dozvole jer se radi o ogradnim i potpornim zidovima.

Unatoč tome, podnositelji prijave su smatrali kako se ne radi o rekonstrukciji građevine već o građenju nove, jer su uklonjeni postojeći zidovi koji su sprječavali klizište. To su izlaskom na teren utvrdili čuvari prirode Javne ustanove, navedeno je u prijavi. Tada je i izdana zabrana radova, ali je u njoj navedeno i da se treba osigurati da ne dođe do klizišta.

Javna ustanova 'oprala ruke'

Time je Javna ustanova zadovoljila javno mnijenje i uznemirene ljubitelje Marjana koji su objavljivali fotografije uz natpise kako ispod Galerije Meštrović izgleda kao da se "otkinulo brdo", a sebe osigurala od krivnje ako dođe do odrona i proklizavanja zemlje na šetnicu.

U rješenju nije precizirano kako se konkretno treba osigurati pokos bez izgradnje zidova. Na državnom odvjetništvu su zato detaljno proučili svu dokumentaciju i iz nje izvukli zaključak koji oslobađa krivnje vlasnicu parcele i investitoricu.

Naime, u građevinskom projektu stoji kako su postojeći zidovi izvedeni od betona loše kvalitete, da kroz pojedine obložne zidove zbog degradacije betona dolazi do prodora zemljanog materijala i da su zidovi zbog poddimenzioniranosti temelja nagnuti u takvom obimu da nije zadovoljen temeljni zahtjev za građevinu: mehanička otpornost i stabilnost.

Građevinari su naveli i da postoji opravdana opasnost od potpunog kolapsa potpornih konstrukcija te je stručnim pregledom utvrđeno kako je potrebno rušenje gotovo svih potporno-obložnih zidova, kao i izvedba zamjenskih sukladno današnjim standardima građevinske struke. Navedeno je da je dio parcele prema zapadu izveden kao zemljani pokos u nagibu od oko 60 stupnjeva u odnosu na horizontalu, te je otežan pristup i otežano je održavanje hortikulture.

Nebitne sitne korekcije

Također se javljaju i povremeni odroni zbog kojih postoji opasnost za susjednu parcelu na kojoj je javno stepenište do mora. Zbog potrebe uklanjanja postojećih zidova, iskorištena je prilika da se pojedini novi zidovi izvedu ponešto dislocirano u odnosu na postojeće zbog bolje iskoristivosti prostora i komunikacije između različitih nivoa.

U projektu je taj dio izveden kao niz kaskadnih ozelenjenih terasa, kao i na ostatku parcele. Stoga se izvode i četiri stubišta za savladavanje različitih razina terena jer do sada pristup pojedinim terasama nije bio moguć. Navodi se kako to kasnije neće biti moguće te je sada iskorištena prilika zbog jedinstvenog pristupa mehanizacije.

Sitne korekcije u izvedbi novog stanja u odnosu na postojeće bit će u potpunosti neprimjetne, pogotovo kada se ponovno izvede ozelenjivanje, stoji u projektu. Za postojeći projekt investitorica je dobila odobrenja nadležnih tijela, između ostalog i pozivanjem na članak 143. Zakona o zaštiti prirode prema kojem radovi neće imati značajan utjecaj na prirodu ukoliko se izvođač bude držao projekta.

Građevinska inspekcija koja je tri puta izlazila na teren nije našla propuste tijekom izvođenja radova na terenu. Nakon izlaska na teren Javne ustanove za upravljanje Park-šumom Marjan i zabrane radova, investitorica je upozorena da nije tražila suglasnost iz članka 144. Zakona o zaštiti prirode te je to naknadno zatražila.

– Navedeni propust ne može se stavljati na teret investitorice koja je prema stajalištu građevinske inspekcije opravdano mogla smatrati da navedena suglasnost nije potrebna – navodi se u rješenju državnog odvjetništva.

Radi se tek o manjem propustu koji se ionako sankcionira u prekršajnom postupku upravo po optužnom prijedlogu Javne ustanove te se time, a i ostalim postupcima, nisu ostvarila obilježja kaznenog djela protupravne gradnje.

Prilikom izgradnje novih potpornih zidova iznad uvale Ježinac na Marjanu nije počinjeno kazneno djelo, zaključeno je na Općinskom državnom odvjetništvu u Splitu. Navedenim rješenjem su odbačene kaznene prijave Javne ustanove za upravljanje Park-šumom Marjan i Društva za zaštitu i unaprjeđenje Marjana protiv investitorice Tereze Žderić, vlasnice parcele s kamenom kućom i zelenim perivojem koja se spušta do šetnice uz more.

Prijave su podnijete zbog sumnje da je počinila kazneno djelo protupravne gradnje unutar zaštićenog dijela prirode i unutar kulturno-povijesne cjeline Meje, na lokaciji Meštrovićevo šetalište 31, u Park-šumi Marjan. Međutim, radovi su odobreni sukladno Pravilniku o jednostavnim i drugim građevinama i radovima bez građevinske dozvole jer se radi o ogradnim i potpornim zidovima.

Unatoč tome, podnositelji prijave su smatrali kako se ne radi o rekonstrukciji građevine već o građenju nove, jer su uklonjeni postojeći zidovi koji su sprječavali klizište. To su izlaskom na teren utvrdili čuvari prirode Javne ustanove, navedeno je u prijavi. Tada je i izdana zabrana radova, ali je u njoj navedeno i da se treba osigurati da ne dođe do klizišta.

Javna ustanova 'oprala ruke'

Time je Javna ustanova zadovoljila javno mnijenje i uznemirene ljubitelje Marjana koji su objavljivali fotografije uz natpise kako ispod Galerije Meštrović izgleda kao da se "otkinulo brdo", a sebe osigurala od krivnje ako dođe do odrona i proklizavanja zemlje na šetnicu.

U rješenju nije precizirano kako se konkretno treba osigurati pokos bez izgradnje zidova. Na državnom odvjetništvu su zato detaljno proučili svu dokumentaciju i iz nje izvukli zaključak koji oslobađa krivnje vlasnicu parcele i investitoricu.

Naime, u građevinskom projektu stoji kako su postojeći zidovi izvedeni od betona loše kvalitete, da kroz pojedine obložne zidove zbog degradacije betona dolazi do prodora zemljanog materijala i da su zidovi zbog poddimenzioniranosti temelja nagnuti u takvom obimu da nije zadovoljen temeljni zahtjev za građevinu: mehanička otpornost i stabilnost.

Građevinari su naveli i da postoji opravdana opasnost od potpunog kolapsa potpornih konstrukcija te je stručnim pregledom utvrđeno kako je potrebno rušenje gotovo svih potporno-obložnih zidova, kao i izvedba zamjenskih sukladno današnjim standardima građevinske struke. Navedeno je da je dio parcele prema zapadu izveden kao zemljani pokos u nagibu od oko 60 stupnjeva u odnosu na horizontalu, te je otežan pristup i otežano je održavanje hortikulture.

Nebitne sitne korekcije

Također se javljaju i povremeni odroni zbog kojih postoji opasnost za susjednu parcelu na kojoj je javno stepenište do mora. Zbog potrebe uklanjanja postojećih zidova, iskorištena je prilika da se pojedini novi zidovi izvedu ponešto dislocirano u odnosu na postojeće zbog bolje iskoristivosti prostora i komunikacije između različitih nivoa.

U projektu je taj dio izveden kao niz kaskadnih ozelenjenih terasa, kao i na ostatku parcele. Stoga se izvode i četiri stubišta za savladavanje različitih razina terena jer do sada pristup pojedinim terasama nije bio moguć. Navodi se kako to kasnije neće biti moguće te je sada iskorištena prilika zbog jedinstvenog pristupa mehanizacije.

Sitne korekcije u izvedbi novog stanja u odnosu na postojeće bit će u potpunosti neprimjetne, pogotovo kada se ponovno izvede ozelenjivanje, stoji u projektu. Za postojeći projekt investitorica je dobila odobrenja nadležnih tijela, između ostalog i pozivanjem na članak 143. Zakona o zaštiti prirode prema kojem radovi neće imati značajan utjecaj na prirodu ukoliko se izvođač bude držao projekta.

Građevinska inspekcija koja je tri puta izlazila na teren nije našla propuste tijekom izvođenja radova na terenu. Nakon izlaska na teren Javne ustanove za upravljanje Park-šumom Marjan i zabrane radova, investitorica je upozorena da nije tražila suglasnost iz članka 144. Zakona o zaštiti prirode te je to naknadno zatražila.

– Navedeni propust ne može se stavljati na teret investitorice koja je prema stajalištu građevinske inspekcije opravdano mogla smatrati da navedena suglasnost nije potrebna – navodi se u rješenju državnog odvjetništva.

Radi se tek o manjem propustu koji se ionako sankcionira u prekršajnom postupku upravo po optužnom prijedlogu Javne ustanove te se time, a i ostalim postupcima, nisu ostvarila obilježja kaznenog djela protupravne gradnje.
