- Odluku o eventualnoj prodaji nekretnine koja je u vlasništvu stečajnog dužnika donosi Skupština vjerovnika, a takav prijedlog može dati i Odbor vjerovnika koji se sastaje idući tjedan. No, činjenica je da u situaciji blokade računa Arena mora zatvoriti svoja vrata. Glavni cilj svakog stečajnog postupka je generalna ovrha, tj. prodaja imovine stečajnog dužnika u cilju namirenja vjerovnika.

U proteklih gotovo osam godina stečajnog postupka takva odluka se nije donosila u prvom redu zbog složenih sudskih postupaka koji se vode između razlučnih vjerovnika i Grada Splita, a i činjenice da je u tom razdoblju stečajni dužnik obavljao djelatnost iz koje su se namirivali troškovi poslovanja i tijekom trajanja stečajnog postupka održavala složena tehnološka i informatička struktura u Spaladium Areni.

Uostalom, nemali broj puta Spaladium Arena udovoljavala je javnim potrebama građana na način da je u interventnim situacijama, kao npr. požar kod Splita prije nekoliko godina trebala poslužiti kao privremeni smještaj ljudi i obitelji s opožarenog područja, zatim kao COVID bolnica te na kraju mjesto na kojem se odvijalo cijepljenje građanstva.

Grad traži 21 milijun kuna

U sadašnjoj situaciji blokade računa svako čekanje na završetak parničnih postupaka je izlišno, a iz razloga što za samog stečajnog dužnika, a time i za vjerovnike nastaju gubici koji se ogledaju u smanjenju stečajne mase - kazala nam je u petak Natalija Mladineo, stečajna upraviteljica tvrtke “Sportski grad TPN d.o.o. u stečaju”, koja je vlasnik splitske Spaladium Arene.

Priča o prodaji Arene aktualizirala se nakon što je Grad Split 26. svibnja blokirao račun “Sportskog grada” na gotovo 21 milijun kuna, odnosno na naplatu je poslano devet ovršnih i izvršnih rješenja za neplaćenu komunalnu i vodnu naknadu.

- Trenutna blokada od Grada generirat će daljnje blokade iz razloga što stečajni dužnik neće biti u mogućnosti podmirivati redovne mjesečne troškove vode, struje, osiguranja objekta, redovnih servisiranja opreme i sl. Važno je istaknuti da u situaciji zatvaranja objekta nema uvjeta za plaćanje zaštitarske službe koja bi čuvala objekt. To su okolnosti vrlo bitne jer mogu dovesti do devastacije objekta - pojasnila je Mladineo.

U svom dopisu, upućenom 8. lipnja ove godine stečajnom sucu Velimiru Vukoviću i predsjedniku Odbora vjerovnika Damjanu Kriviću, navela je da je “u ovakvim okolnostima nužno da sud i članovi Odbora vjerovnika budu transparentno upoznati s obvezama stečajnog dužnika jer u uvjetima blokade računa neće biti moguće nastaviti poslovanje, a niti udovoljiti uvjetima održavanja Europskog prvenstva u vaterpolu (koje bi se trebalo održati koncem kolovoza i početkom rujna - op.a.).

- Na ovu činjenicu nadovezuje se i vještvo dr. Wintona Afrića, nadopunjeno na traženje razlučnog vjerovnika u kolovozu 2021., a u kojem je utvrđeno da svaki prestanak napajanja Spaladium Arene električnom energijom vodi kumulativnim štetama na tehničkoj i informatičkoj opremi koje protekom vremena izazivaju nenadoknadive štete. Sve te okolnosti navode na zaključak da će zatvaranjem objekta započeti proces devastacije - vrlo je jasna stečajna upraviteljica.

Podsjetimo na to da su Grad Split i "TPN Sportski grad" sklopili Ugovor o javno-privatnom partnerstvu pod nazivom “Projekt Športsko poslovnog kompleksa Lora u Splitu”, a u ime Grada Splita pregovarač je bio prof. Dejan Kružić koji je tada, prije 15 godina, predložio gradskim vijećnicima sklapanje ugovora.

Sporni ‘Kuretovi aneksi’

Privatni partner obvezao se tada uložiti oko 140 milijuna eura u izgradnju četiri objekta - sportske dvorane, garaže na osam etaža s više od 1500 parkirališnih mjesta, hotela s kongresnom dvoranom i trgovačkog centra, sve bez ikakvog financijskog sudjelovanja i jamstava Grada Splita. Od svih tih planiranih objekata izgrađena je samo Spaladium Arena.

Danas je dobro poznato da su Grad Split i TPN Sportski grad 2008. i 2009. godine sklopili tzv. “Kuretove anekse” kojima su nastale bitne izmjene i dopune osnovnog Ugovora koje, pak, nisu dobile suglasnost nadležnih državnih tijela niti su dodaci stavljeni na uvid Kružiću i vijećnicima Gradskog vijeća. Tadašnji HDZ-ov gradonačelnik ih je potpisao bez suglasnosti vijećnika i skriveno od javnosti, a sklapanjem dodataka postupilo se suprotno modelu JPP-a, koji su gradski vijećnici prihvatili.

Umjesto da se projekt u Lori realizira kao što je to bilo ugovoreno, bez financijskog sudjelovanja i jamstava Grada Splita, “Kuretovim aneksima” se, javno upozorava prof. Kružić, na pravno nedopušten i nezakonit način radikalno izmijenila pozicija Grada Splita tako da sad Grad Split postaje obveznik otplate kredita privatnog partnera.

Kružić godinama, kao splitski “Don Quijote”, vodi sudske bitke želeći dokazati da su “Kuretovi aneksi” ništetni, a Trgovački sud u Splitu je u veljači prošle godine odbacio Kružićevu tužbu kao nedopuštenu uz obrazloženje da on nema pravni interes za tužbu. No, Visoki trgovački sud je tu presudu ukinuo i vratio na ponovno odlučivanje.

- U ovoj fazi postupka ne želim komentirati presudu VTS-a jer bi se bilo kakav moj komentar mogao tumačiti kao pritisak na splitski sud. Želim što skoriji nastavak suđenja i da se postupak koji traje već više od pet godina napokon okonča. Nakon po odvjetniku Krunu Peronji maestralno odrađenog postupka poništenja arbitražnog pravorijeka građani Splita mogu biti mirni – od nepostojećeg potraživanja od oko 650 milijuna kuna u konačnici neće biti naplaćena niti jedna lipa - kazao nam je Kružić.

- Odluku o eventualnoj prodaji nekretnine koja je u vlasništvu stečajnog dužnika donosi Skupština vjerovnika, a takav prijedlog može dati i Odbor vjerovnika koji se sastaje idući tjedan. No, činjenica je da u situaciji blokade računa Arena mora zatvoriti svoja vrata. Glavni cilj svakog stečajnog postupka je generalna ovrha, tj. prodaja imovine stečajnog dužnika u cilju namirenja vjerovnika.

U proteklih gotovo osam godina stečajnog postupka takva odluka se nije donosila u prvom redu zbog složenih sudskih postupaka koji se vode između razlučnih vjerovnika i Grada Splita, a i činjenice da je u tom razdoblju stečajni dužnik obavljao djelatnost iz koje su se namirivali troškovi poslovanja i tijekom trajanja stečajnog postupka održavala složena tehnološka i informatička struktura u Spaladium Areni.

Uostalom, nemali broj puta Spaladium Arena udovoljavala je javnim potrebama građana na način da je u interventnim situacijama, kao npr. požar kod Splita prije nekoliko godina trebala poslužiti kao privremeni smještaj ljudi i obitelji s opožarenog područja, zatim kao COVID bolnica te na kraju mjesto na kojem se odvijalo cijepljenje građanstva.

Grad traži 21 milijun kuna

U sadašnjoj situaciji blokade računa svako čekanje na završetak parničnih postupaka je izlišno, a iz razloga što za samog stečajnog dužnika, a time i za vjerovnike nastaju gubici koji se ogledaju u smanjenju stečajne mase - kazala nam je u petak Natalija Mladineo, stečajna upraviteljica tvrtke “Sportski grad TPN d.o.o. u stečaju”, koja je vlasnik splitske Spaladium Arene.

Priča o prodaji Arene aktualizirala se nakon što je Grad Split 26. svibnja blokirao račun “Sportskog grada” na gotovo 21 milijun kuna, odnosno na naplatu je poslano devet ovršnih i izvršnih rješenja za neplaćenu komunalnu i vodnu naknadu.

- Trenutna blokada od Grada generirat će daljnje blokade iz razloga što stečajni dužnik neće biti u mogućnosti podmirivati redovne mjesečne troškove vode, struje, osiguranja objekta, redovnih servisiranja opreme i sl. Važno je istaknuti da u situaciji zatvaranja objekta nema uvjeta za plaćanje zaštitarske službe koja bi čuvala objekt. To su okolnosti vrlo bitne jer mogu dovesti do devastacije objekta - pojasnila je Mladineo.

U svom dopisu, upućenom 8. lipnja ove godine stečajnom sucu Velimiru Vukoviću i predsjedniku Odbora vjerovnika Damjanu Kriviću, navela je da je “u ovakvim okolnostima nužno da sud i članovi Odbora vjerovnika budu transparentno upoznati s obvezama stečajnog dužnika jer u uvjetima blokade računa neće biti moguće nastaviti poslovanje, a niti udovoljiti uvjetima održavanja Europskog prvenstva u vaterpolu (koje bi se trebalo održati koncem kolovoza i početkom rujna - op.a.).

- Na ovu činjenicu nadovezuje se i vještvo dr. Wintona Afrića, nadopunjeno na traženje razlučnog vjerovnika u kolovozu 2021., a u kojem je utvrđeno da svaki prestanak napajanja Spaladium Arene električnom energijom vodi kumulativnim štetama na tehničkoj i informatičkoj opremi koje protekom vremena izazivaju nenadoknadive štete. Sve te okolnosti navode na zaključak da će zatvaranjem objekta započeti proces devastacije - vrlo je jasna stečajna upraviteljica.

Podsjetimo na to da su Grad Split i "TPN Sportski grad" sklopili Ugovor o javno-privatnom partnerstvu pod nazivom “Projekt Športsko poslovnog kompleksa Lora u Splitu”, a u ime Grada Splita pregovarač je bio prof. Dejan Kružić koji je tada, prije 15 godina, predložio gradskim vijećnicima sklapanje ugovora.

Sporni ‘Kuretovi aneksi’

Privatni partner obvezao se tada uložiti oko 140 milijuna eura u izgradnju četiri objekta - sportske dvorane, garaže na osam etaža s više od 1500 parkirališnih mjesta, hotela s kongresnom dvoranom i trgovačkog centra, sve bez ikakvog financijskog sudjelovanja i jamstava Grada Splita. Od svih tih planiranih objekata izgrađena je samo Spaladium Arena.

Danas je dobro poznato da su Grad Split i TPN Sportski grad 2008. i 2009. godine sklopili tzv. “Kuretove anekse” kojima su nastale bitne izmjene i dopune osnovnog Ugovora koje, pak, nisu dobile suglasnost nadležnih državnih tijela niti su dodaci stavljeni na uvid Kružiću i vijećnicima Gradskog vijeća. Tadašnji HDZ-ov gradonačelnik ih je potpisao bez suglasnosti vijećnika i skriveno od javnosti, a sklapanjem dodataka postupilo se suprotno modelu JPP-a, koji su gradski vijećnici prihvatili.

Umjesto da se projekt u Lori realizira kao što je to bilo ugovoreno, bez financijskog sudjelovanja i jamstava Grada Splita, “Kuretovim aneksima” se, javno upozorava prof. Kružić, na pravno nedopušten i nezakonit način radikalno izmijenila pozicija Grada Splita tako da sad Grad Split postaje obveznik otplate kredita privatnog partnera.

Kružić godinama, kao splitski “Don Quijote”, vodi sudske bitke želeći dokazati da su “Kuretovi aneksi” ništetni, a Trgovački sud u Splitu je u veljači prošle godine odbacio Kružićevu tužbu kao nedopuštenu uz obrazloženje da on nema pravni interes za tužbu. No, Visoki trgovački sud je tu presudu ukinuo i vratio na ponovno odlučivanje.

- U ovoj fazi postupka ne želim komentirati presudu VTS-a jer bi se bilo kakav moj komentar mogao tumačiti kao pritisak na splitski sud. Želim što skoriji nastavak suđenja i da se postupak koji traje već više od pet godina napokon okonča. Nakon po odvjetniku Krunu Peronji maestralno odrađenog postupka poništenja arbitražnog pravorijeka građani Splita mogu biti mirni – od nepostojećeg potraživanja od oko 650 milijuna kuna u konačnici neće biti naplaćena niti jedna lipa - kazao nam je Kružić.
