"Komunalno redarstvo bi trebalo urgirati da se turska zastava ukloni iz središta Dubrovnika", izjava je izrečena na posljednjoj sjednici Gradskog vijeća, prošlog tjedna, a odnosi se na stijeg pred nekadašnjim hotelom "Libertas", danas "Rixos Premium Dubrovnik".
Rečeno je tada da je isticanje zastave druge države, osim na veleposlanstvima i konzulatima, nezakonito. Međutim, pokazalo se da zakon, uz jedan uvjet, ne zabranjuje vijorenje stranih barjaka na hrvatskoj zemlji, pa to vrijedi i za "bayrak". Taj uvjet je ishođena dozvola policije.
"Policijska uprava dubrovačko-neretvanska nije postupala po obavijesti komunalnog društva Grada Dubrovnika, a radi se o prekršaju iz čl. 26. Zakona o prekršajima protiv javnog reda i mira, gdje policija postupa po službenoj dužnosti. Nakon utvrđivanja prekršaja, Policijska postaja Dubrovnik je pravnoj osobi, hotelu 'Rixos Premium Dubrovnik', sukladno prekršajnom zakonu, izdala pisanu naredbu s danom obvezom i rokom za ispunjenje obveze, koja je potom i ispunjena, te je ova Policijska uprava, 12. listopada 2020. godine, Rješenjem odobrila isticanje zastave treće zemlje – Republike Turske, uz zastavu RH i EU ispred navedenog hotela", navode iz Policijske uprave dubrovačko-neretvanske.
Hotelska uprava, dakle, nije imala dopuštenje policije, ali su je, nakon polemike u Vijeću, ishodili. Riješena stvar.
– Odredba Zakona o prekršajima protiv javnog reda i mira iz 1974. godine prilično je anakrona, upotrebljava terminologiju "društveno-političkih organizacija" koje su odavno zaboravljene kao koncept – kaže dr. sc. Željko Heimer, predsjednik Međunarodne federacije veksiloloških udruga, kao i Hrvatskog grboslovnog i zastavoslovnog društva.
– Činjenica je – kaže bojnik Heimer, inače doktor sociologije – da mnoge tvrtke širom Hrvatske koje su u stranom vlasništvu ili imaju kakve druge kontakte sa stranim osobama ističu zastave tih država.
I sam je na raznim lokacijama ispred tvornica, trgovina ili drugih poslovnih objekata uočio zastave Republike Austrije, Kraljevine Švedske, Kanade, Velike Britanije, Sjedinjenih Američkih Država... Obično se takve zastave ističu zajedno sa zastavom Republike Hrvatske, a tipično i s jednom ili više zastava kompanije. Štoviše, nije neobično da se ispred hotela ističu razne nacionalne zastave koje imaju ili nemaju veze s vlasničkom strukturom, često kao šareni ornamenti koji ukrašavaju hotelski ulaz i naglašavaju internacionalnost klijentele.
– Ne vidim razloga zašto bi u ovom slučaju bilo drukčije. Također, nisam siguran da druge spomenute kompanije imaju ishođene dozvole policije, no ne vidim razloga da bi policija takvu dozvolu uskratila, osobito ako se zastava ističe uz hrvatsku zastavu, pa time ne dovodi do možebitne identitetske zabune. Naravno, sudska praksa poznaje primjere kažnjavanja pojedinaca koji bi istaknuli strane zastave, no obično se radilo, ako se ne varam, o takvim isticanjima koja su se mogla protumačiti kao iskazivanje teritorijalnih posezanja. Dakle, ne vidim sporno da se zajedno sa zastavom RH istakne i zastava Republike Turske, nama prijateljske, dapače i savezničke države u okviru Sjevernoatlantskog saveza. Takvo proklamirano savezništvo moglo bi se protumačiti i kao prekršajnim zakonom traženi "poziv društveno-političke organizacije", a bilo bi zanimljivo vidjeti na temelju čega bi policija eventualno uskratila odobrenje. "Komunalno redarstvo bi trebalo urgirati da se turska zastava ukloni iz središta Dubrovnika", izjava je izrečena na posljednjoj sjednici Gradskog vijeća, prošlog tjedna, a odnosi se na stijeg pred nekadašnjim hotelom "Libertas", danas "Rixos Premium Dubrovnik".
Rečeno je tada da je isticanje zastave druge države, osim na veleposlanstvima i konzulatima, nezakonito. Međutim, pokazalo se da zakon, uz jedan uvjet, ne zabranjuje vijorenje stranih barjaka na hrvatskoj zemlji, pa to vrijedi i za "bayrak". Taj uvjet je ishođena dozvola policije.
"Policijska uprava dubrovačko-neretvanska nije postupala po obavijesti komunalnog društva Grada Dubrovnika, a radi se o prekršaju iz čl. 26. Zakona o prekršajima protiv javnog reda i mira, gdje policija postupa po službenoj dužnosti. Nakon utvrđivanja prekršaja, Policijska postaja Dubrovnik je pravnoj osobi, hotelu 'Rixos Premium Dubrovnik', sukladno prekršajnom zakonu, izdala pisanu naredbu s danom obvezom i rokom za ispunjenje obveze, koja je potom i ispunjena, te je ova Policijska uprava, 12. listopada 2020. godine, Rješenjem odobrila isticanje zastave treće zemlje – Republike Turske, uz zastavu RH i EU ispred navedenog hotela", navode iz Policijske uprave dubrovačko-neretvanske.
Hotelska uprava, dakle, nije imala dopuštenje policije, ali su je, nakon polemike u Vijeću, ishodili. Riješena stvar.
– Odredba Zakona o prekršajima protiv javnog reda i mira iz 1974. godine prilično je anakrona, upotrebljava terminologiju "društveno-političkih organizacija" koje su odavno zaboravljene kao koncept – kaže dr. sc. Željko Heimer, predsjednik Međunarodne federacije veksiloloških udruga, kao i Hrvatskog grboslovnog i zastavoslovnog društva.
– Činjenica je – kaže bojnik Heimer, inače doktor sociologije – da mnoge tvrtke širom Hrvatske koje su u stranom vlasništvu ili imaju kakve druge kontakte sa stranim osobama ističu zastave tih država.
I sam je na raznim lokacijama ispred tvornica, trgovina ili drugih poslovnih objekata uočio zastave Republike Austrije, Kraljevine Švedske, Kanade, Velike Britanije, Sjedinjenih Američkih Država... Obično se takve zastave ističu zajedno sa zastavom Republike Hrvatske, a tipično i s jednom ili više zastava kompanije. Štoviše, nije neobično da se ispred hotela ističu razne nacionalne zastave koje imaju ili nemaju veze s vlasničkom strukturom, često kao šareni ornamenti koji ukrašavaju hotelski ulaz i naglašavaju internacionalnost klijentele.
– Ne vidim razloga zašto bi u ovom slučaju bilo drukčije. Također, nisam siguran da druge spomenute kompanije imaju ishođene dozvole policije, no ne vidim razloga da bi policija takvu dozvolu uskratila, osobito ako se zastava ističe uz hrvatsku zastavu, pa time ne dovodi do možebitne identitetske zabune. Naravno, sudska praksa poznaje primjere kažnjavanja pojedinaca koji bi istaknuli strane zastave, no obično se radilo, ako se ne varam, o takvim isticanjima koja su se mogla protumačiti kao iskazivanje teritorijalnih posezanja. Dakle, ne vidim sporno da se zajedno sa zastavom RH istakne i zastava Republike Turske, nama prijateljske, dapače i savezničke države u okviru Sjevernoatlantskog saveza. Takvo proklamirano savezništvo moglo bi se protumačiti i kao prekršajnim zakonom traženi "poziv društveno-političke organizacije", a bilo bi zanimljivo vidjeti na temelju čega bi policija eventualno uskratila odobrenje. Svakako, moram se ograditi od toga da moje mišljenje nije pravni savjet – navodi na kraju dr. sc. Heimer.
