Dvaput je već Sud izlazio na teren na Lopud po pitanju 35,5 metara visoka odašiljača koji je tvrtka Odašiljači i veze montirala iznad mjesta. Zbog opće ocjene da je toliki odašiljač, gotovo tri puta veći od ranijeg, koji nadvisuje otok potreban, no invazivan i sasvim neprimjeren, prosvjedovali su stanovnici koji su pokrenuli online peticiju kojom od tvrtke Odašiljači i veze traže da obustavi sve radovi na zamjeni starog odašiljača i nađe nova lokacija. S pravne strane, vodi se borba oko toga je li sadašnji odašiljač zakonito postavljen, odnosno radi li se o zamjeni ranijeg odašiljača kako to tvrde OiV, ili je riječ o novoj građevini za koju je potrebna znatno šira dokumentaciju i više dozvola.
Niko Merdžan odvjetnik koji zastupa nekoliko vlasnika okolnih zemljišnoknjižnih čestica pokrenuo je postupak osiguranja dokaza na zemljišnoj čestici 528 k.o. Lopud, na kojoj se nalaz sporni odašiljač. On potvrđuje kako su se tijekom tog postupka, obzirom da je Općinski sud prihvatio prijedlog za osiguranje dokaza, dogodila dva izlaska na lice mjesta uz sudjelovanje vještaka građevinske struke te vještaka telekomunikacijske struke. Vještaci nakon zaprimanja dokumentacije od obje strane, moraju izraditi stručne nalaze i mišljenja. Ti nalazi i mišljenja vještaka trebali bi sadržavati odgovore na bitna pitanja u ovom predmetu usmjerena ka utvrđenju postojanja ili nepostojanja legalnosti, sa svih gledišta, postupanja društva Odašiljači i veze d.o.o. prilikom izvođenja radova ovog tipa na čestici 528 k.o. Lopud. Navedeni postupak je još uvijek u tijeku, navodi Merdžan.
- Usporedno s ovim postupkom, pokrenut je i postupak osiguranja određivanjem privremene mjere kojim prijedlogom se traži da sud izreče takvu mjeru zabrane društvu Odašiljači i veze d.o.o., da izvodi bilo kakve građevinske radove na zemljišnoj čestici 528 k.o. Lopud uz zabranu da dovođenjem građevinskog materijala, strojeva i opreme mijenja postojeće stanje građevine na zemljišnoj čestici 528 k.o. Lopud, sve to pod prijetnjom novčane kazne. Sud je 11. ožujka prihvatio takav prijedlog te donio takvo rješenje o osiguranju. Ovo rješenje odmah proizvodi pravne učinke, odnosno žalba ga ne događa što znači da protivnik osiguranja, do okončanja ranije opisanog postupka osiguranja dokaza, ne smije, bez novčane kazne, izvoditi nikakve daljnje radove – ističe odvjetnik Niko Merdžan.
Podsjetimo, i kako je Povjerenstvo Grada Dubrovnika i OiV čija glavna zadaća izrada konkretnog prijedloga koji bi predstavljao optimalno rješenje na zadovoljstvo svih zainteresiranih strana, također obilazilo spornu lokaciju na otoku, no Lopuđani ne pristaju na prijedlog „maskiranja“, odnosno kamuflaže antenskog stupa koji je u potpunosti narušio vizuru Lopuda.
Odašiljač je postavljen u najgušće naseljenom dijelu otoka, tik do zaštićene spomeničke građe i brojnih obnovljenih kuća i vila za odmor u kojima u ljetnim mjesecima borave brojni domaći i strani gosti. Lopuđani na otoku i oni širom svijeta koji na otoku imaju nekretnine, a organizirali su se u zaštiti otoka, ističu i kako su institucije uključene u davanje suglasnosti za izgradnju ovog odašiljača propustile uzeti u obzir da je čestica na kojoj je postavljen odašiljač na području arheološke zone Sutmiho te je istovremeno i označena kao prirodni habitat, te da se na njoj ne može ništa raditi bez nadzora i odobrenja konzervatora.

Dvaput je već Sud izlazio na teren na Lopud po pitanju 35,5 metara visoka odašiljača koji je tvrtka Odašiljači i veze montirala iznad mjesta. Zbog opće ocjene da je toliki odašiljač, gotovo tri puta veći od ranijeg, koji nadvisuje otok potreban, no invazivan i sasvim neprimjeren, prosvjedovali su stanovnici koji su pokrenuli online peticiju kojom od tvrtke Odašiljači i veze traže da obustavi sve radovi na zamjeni starog odašiljača i nađe nova lokacija. S pravne strane, vodi se borba oko toga je li sadašnji odašiljač zakonito postavljen, odnosno radi li se o zamjeni ranijeg odašiljača kako to tvrde OiV, ili je riječ o novoj građevini za koju je potrebna znatno šira dokumentaciju i više dozvola.
Niko Merdžan odvjetnik koji zastupa nekoliko vlasnika okolnih zemljišnoknjižnih čestica pokrenuo je postupak osiguranja dokaza na zemljišnoj čestici 528 k.o. Lopud, na kojoj se nalaz sporni odašiljač. On potvrđuje kako su se tijekom tog postupka, obzirom da je Općinski sud prihvatio prijedlog za osiguranje dokaza, dogodila dva izlaska na lice mjesta uz sudjelovanje vještaka građevinske struke te vještaka telekomunikacijske struke. Vještaci nakon zaprimanja dokumentacije od obje strane, moraju izraditi stručne nalaze i mišljenja. Ti nalazi i mišljenja vještaka trebali bi sadržavati odgovore na bitna pitanja u ovom predmetu usmjerena ka utvrđenju postojanja ili nepostojanja legalnosti, sa svih gledišta, postupanja društva Odašiljači i veze d.o.o. prilikom izvođenja radova ovog tipa na čestici 528 k.o. Lopud. Navedeni postupak je još uvijek u tijeku, navodi Merdžan.
- Usporedno s ovim postupkom, pokrenut je i postupak osiguranja određivanjem privremene mjere kojim prijedlogom se traži da sud izreče takvu mjeru zabrane društvu Odašiljači i veze d.o.o., da izvodi bilo kakve građevinske radove na zemljišnoj čestici 528 k.o. Lopud uz zabranu da dovođenjem građevinskog materijala, strojeva i opreme mijenja postojeće stanje građevine na zemljišnoj čestici 528 k.o. Lopud, sve to pod prijetnjom novčane kazne. Sud je 11. ožujka prihvatio takav prijedlog te donio takvo rješenje o osiguranju. Ovo rješenje odmah proizvodi pravne učinke, odnosno žalba ga ne događa što znači da protivnik osiguranja, do okončanja ranije opisanog postupka osiguranja dokaza, ne smije, bez novčane kazne, izvoditi nikakve daljnje radove – ističe odvjetnik Niko Merdžan.
Podsjetimo, i kako je Povjerenstvo Grada Dubrovnika i OiV čija glavna zadaća izrada konkretnog prijedloga koji bi predstavljao optimalno rješenje na zadovoljstvo svih zainteresiranih strana, također obilazilo spornu lokaciju na otoku, no Lopuđani ne pristaju na prijedlog „maskiranja“, odnosno kamuflaže antenskog stupa koji je u potpunosti narušio vizuru Lopuda.
Odašiljač je postavljen u najgušće naseljenom dijelu otoka, tik do zaštićene spomeničke građe i brojnih obnovljenih kuća i vila za odmor u kojima u ljetnim mjesecima borave brojni domaći i strani gosti. Lopuđani na otoku i oni širom svijeta koji na otoku imaju nekretnine, a organizirali su se u zaštiti otoka, ističu i kako su institucije uključene u davanje suglasnosti za izgradnju ovog odašiljača propustile uzeti u obzir da je čestica na kojoj je postavljen odašiljač na području arheološke zone Sutmiho te je istovremeno i označena kao prirodni habitat, te da se na njoj ne može ništa raditi bez nadzora i odobrenja konzervatora.
