Hrvatska će biti jedna od prvih u Europskoj uniji s konkretnim mjerama protiv SLAPP tužbi koje će ući u novi zakon o medijima, ističu u Ministarstvu kulture i medija dok su novinarske organizacije razočarane usvajanjem ‘‘razvodnjene‘‘ AntiSLAPP direktive na razini Vijeća EU, piše HINA.

SLAPP tužbe su neutemeljene tužbe pokrenute s pozicije moći radi zastrašivanje i utišavanje kritičkih glasova u društvu o pitanjima od javnog interesa, a žrtve takvih tužbi najčešće su novinari i mediji. Vijeće Europske unije usvojilo je početkom lipnja zajedničko stajalište o  Anti-SLAPP direktivi. Nova regulativa, koji je Europska komisija predložila 2022., namijenjena je rješavanju rastućeg problema strateških tužbi usmjerenih na novinare, aktiviste i druge javne kritičke glasove diljem Europe.

Novinarske organizacije: Daleko od izvornog cilja zakona

No, Europska federacija novinara (EFJ) smatra da tekst, koji je znatno ‘‘razvodnjen‘‘, daleko zaostaje za izvornim ciljem zakona o zaštiti novinara i prava na informaciju u EU. Slično je reagirao i Sindikat novinara Hrvatske (SNH) koji je otvorenim pismom izrazio razočaranje Općim pristupom koji je usvojilo Vijeće Europske unije.

‘‘Ovim stavom Vijeće čini korak unatrag u borbi protiv sve češćeg korištenja neutemeljenih i zlouporabnih sudskih postupaka značajno razvodnjavajući ključne odredbe u izvornom tekstu‘‘ ističu u SNH kojem je, kao i Europskoj federaciji novinara, na čelu Maja Sever.

Novinarske organizacije pritom navode i tri velika nedostatka zbog kojih se ne uspijeva pružiti učinkovit i adekvatan ‘‘zaštitni‘‘ okvir za novinare i medijske kuće. Ističu da se ograničivanjem područja primjene direktive na čiste ‘‘prekogranične‘‘ slučajeve, odnosno slučajeve u kojima se kazneni progon odvija u drugoj državi članici EU-a, izostavlja većina SLAPP tužbi iz područja primjene direktive.

Dodaju i da istraživanja pokazuju da se otprilike 90 posto slučajeva SLAPP-a u Europi pokreće u istoj jurisdikciji u kojoj njihova ‘‘meta‘‘ ima prebivalište. Kao drugi nedostatak navode vrlo restriktivnu definiciju “očigledno neutemeljenih slučajeva” što značajno slabi ključni mehanizam ranog odbacivanja tužbe i smanjuje zaštitu dostupnu ‘‘meti‘‘ te zaključno - brisanje odredbe o naknadi štete za one koji su bili meta SLAPP tužbi.

‘‘Ove odredbe daleko su od izvornog cilja zakona, a to je zaštita novinara, branitelja ljudskih prava i konačno prava na informacije u Europskoj uniji‘‘, zaključuju u SNH. Stoga, pozivaju i nadležne institucije da ‘‘rade na zakonodavstvu koje će učinkovito zaštititi novinare, branitelje ljudskih prava i druge sudionike u javnosti od SLAPP-ova‘‘.

Ministarstvo: Neupitna i jasna podrška neovisnom novinarstvu

S druge strane, otvoreno pismo SNH-a za Hinu je komentiralo i Ministarstvo kulture i medija. ‘‘Treba jasno reći da nema mjesta za takve optužbe što se Hrvatske tiče. Jer, najavili smo da ćemo bez obzira na konačni tekst direktive, koja se odnosi na prekogranične slučajeve, odredbe o ranom prepoznavanju i odbacivanju SLAPP tužbi uključiti u naš novi zakon o medijima‘‘, ističu u ministarstvu.

‘‘Cilj nam je da takve neosnovane i zlonamjerne tužbe budu rano prepoznate i odbačene, kako bi novinari mogli slobodno i neometano istraživati sve teme od javnog interesa‘‘, zaključuju u ministarstvu kulture i medija.

Hrvatska će biti jedna od prvih u Europskoj uniji s konkretnim mjerama protiv SLAPP tužbi koje će ući u novi zakon o medijima, ističu u Ministarstvu kulture i medija dok su novinarske organizacije razočarane usvajanjem ‘‘razvodnjene‘‘ AntiSLAPP direktive na razini Vijeća EU, piše HINA.

SLAPP tužbe su neutemeljene tužbe pokrenute s pozicije moći radi zastrašivanje i utišavanje kritičkih glasova u društvu o pitanjima od javnog interesa, a žrtve takvih tužbi najčešće su novinari i mediji. Vijeće Europske unije usvojilo je početkom lipnja zajedničko stajalište o  Anti-SLAPP direktivi. Nova regulativa, koji je Europska komisija predložila 2022., namijenjena je rješavanju rastućeg problema strateških tužbi usmjerenih na novinare, aktiviste i druge javne kritičke glasove diljem Europe.

Novinarske organizacije: Daleko od izvornog cilja zakona

No, Europska federacija novinara (EFJ) smatra da tekst, koji je znatno ‘‘razvodnjen‘‘, daleko zaostaje za izvornim ciljem zakona o zaštiti novinara i prava na informaciju u EU. Slično je reagirao i Sindikat novinara Hrvatske (SNH) koji je otvorenim pismom izrazio razočaranje Općim pristupom koji je usvojilo Vijeće Europske unije.

‘‘Ovim stavom Vijeće čini korak unatrag u borbi protiv sve češćeg korištenja neutemeljenih i zlouporabnih sudskih postupaka značajno razvodnjavajući ključne odredbe u izvornom tekstu‘‘ ističu u SNH kojem je, kao i Europskoj federaciji novinara, na čelu Maja Sever.

Novinarske organizacije pritom navode i tri velika nedostatka zbog kojih se ne uspijeva pružiti učinkovit i adekvatan ‘‘zaštitni‘‘ okvir za novinare i medijske kuće. Ističu da se ograničivanjem područja primjene direktive na čiste ‘‘prekogranične‘‘ slučajeve, odnosno slučajeve u kojima se kazneni progon odvija u drugoj državi članici EU-a, izostavlja većina SLAPP tužbi iz područja primjene direktive.

Dodaju i da istraživanja pokazuju da se otprilike 90 posto slučajeva SLAPP-a u Europi pokreće u istoj jurisdikciji u kojoj njihova ‘‘meta‘‘ ima prebivalište. Kao drugi nedostatak navode vrlo restriktivnu definiciju “očigledno neutemeljenih slučajeva” što značajno slabi ključni mehanizam ranog odbacivanja tužbe i smanjuje zaštitu dostupnu ‘‘meti‘‘ te zaključno - brisanje odredbe o naknadi štete za one koji su bili meta SLAPP tužbi.

‘‘Ove odredbe daleko su od izvornog cilja zakona, a to je zaštita novinara, branitelja ljudskih prava i konačno prava na informacije u Europskoj uniji‘‘, zaključuju u SNH. Stoga, pozivaju i nadležne institucije da ‘‘rade na zakonodavstvu koje će učinkovito zaštititi novinare, branitelje ljudskih prava i druge sudionike u javnosti od SLAPP-ova‘‘.

Ministarstvo: Neupitna i jasna podrška neovisnom novinarstvu

S druge strane, otvoreno pismo SNH-a za Hinu je komentiralo i Ministarstvo kulture i medija. ‘‘Treba jasno reći da nema mjesta za takve optužbe što se Hrvatske tiče. Jer, najavili smo da ćemo bez obzira na konačni tekst direktive, koja se odnosi na prekogranične slučajeve, odredbe o ranom prepoznavanju i odbacivanju SLAPP tužbi uključiti u naš novi zakon o medijima‘‘, ističu u ministarstvu.

‘‘Cilj nam je da takve neosnovane i zlonamjerne tužbe budu rano prepoznate i odbačene, kako bi novinari mogli slobodno i neometano istraživati sve teme od javnog interesa‘‘, zaključuju u ministarstvu kulture i medija.

Hrvatska će biti jedna od prvih u Europskoj uniji s konkretnim mjerama protiv SLAPP tužbi koje će ući u novi zakon o medijima, ističu u Ministarstvu kulture i medija dok su novinarske organizacije razočarane usvajanjem ‘‘razvodnjene‘‘ AntiSLAPP direktive na razini Vijeća EU, piše HINA.

SLAPP tužbe su neutemeljene tužbe pokrenute s pozicije moći radi zastrašivanje i utišavanje kritičkih glasova u društvu o pitanjima od javnog interesa, a žrtve takvih tužbi najčešće su novinari i mediji. Vijeće Europske unije usvojilo je početkom lipnja zajedničko stajalište o  Anti-SLAPP direktivi. Nova regulativa, koji je Europska komisija predložila 2022., namijenjena je rješavanju rastućeg problema strateških tužbi usmjerenih na novinare, aktiviste i druge javne kritičke glasove diljem Europe.

Novinarske organizacije: Daleko od izvornog cilja zakona

No, Europska federacija novinara (EFJ) smatra da tekst, koji je znatno ‘‘razvodnjen‘‘, daleko zaostaje za izvornim ciljem zakona o zaštiti novinara i prava na informaciju u EU. Slično je reagirao i Sindikat novinara Hrvatske (SNH) koji je otvorenim pismom izrazio razočaranje Općim pristupom koji je usvojilo Vijeće Europske unije.
