Odluku o izvršenju presude Zoran Mamić odlučio je čekati u Bosni i Hercegovini, a zatražio je i da tamo odsluži zatvorsku kaznu.
Na taj konkretan slučaj danas se osvrnuo i USKOK čije priopćenje donosimo u cijelosti:
- Zbog interesa javnosti te povodom brojnih upita novinara o razlozima nepredlaganja mjera opreza u aktualnom kaznenom postupku, navodimo da USKOK nije predložio nadležnom sudu izricanje mjera opreza zbog opasnosti od bijega jer nisu bile ispunjene zakonske pretpostavke za podnošenje prijedloga.
Prije svega, podsjećamo da je USKOK, nezadovoljan odlukom suda o visini izrečene kazne, podnio žalbu na prvostupanjsku presudu i očekivao da će ona, s obzirom na u njoj iznesene razloge, biti usvojena (izricanje kazne u trajanju od pet godina ili više) u kojem bi slučaju istražni zatvor bio obligatoran.
Nadalje, prema odredbi članka 98. stavka 5. Zakona o kaznenom postupku nakon podizanja optužnice pa do pravomoćnosti odnosno izvršnosti presude mjere opreza određuje, produljuje i ukida prvostupanjski sud. To znači da mjere opreza može izreći, ako su ispunjene pretpostavke, prvostupanjski sud po službenoj dužnosti ili na prijedlog nadležnog državnog odvjetništva.
U konkretnom slučaju, tijekom kaznenog postupka sada pravomoćno osuđeni Zoran Mamić uredno se odazivao sudskim pozivima te nije izbjegavao prijam pismena suda i USKOK-a. Osim toga ima prijavljeno prebivalište i vlasnik je nekretnina u Republici Hrvatskoj gdje žive članovi njegove obitelji i gdje se odvijala njegova poslovna aktivnost zbog koje je često napuštao Republiku Hrvatsku te se u nju vraćao.
Cijeneći sve naprijed navedeno, sama činjenica da imenovani ima i državljanstvo Bosne i Hercegovine koje je ostvario na temelju svog porijekla, ne predstavlja zakonom predviđenu osobitu okolnost opasnosti od bijega iz članka 123. stavka 1. točke 1. Zakona o kaznenom postupku i stoga ne predstavlja dostatan temelj za predlaganje određivanja istražnog zatvora.
Posebno ističemo da, sukladno važećim odredbama Zakona o kaznenom postupku, a dok se navedene odredbe u propisanoj proceduri eventualno ne izmijene, ako nema uvjeta za predlaganje istražnog zatvora onda nema ni uvjeta za predlaganje mjera opreza- kazali su.

Odluku o izvršenju presude Zoran Mamić odlučio je čekati u Bosni i Hercegovini, a zatražio je i da tamo odsluži zatvorsku kaznu.
Na taj konkretan slučaj danas se osvrnuo i USKOK čije priopćenje donosimo u cijelosti:
- Zbog interesa javnosti te povodom brojnih upita novinara o razlozima nepredlaganja mjera opreza u aktualnom kaznenom postupku, navodimo da USKOK nije predložio nadležnom sudu izricanje mjera opreza zbog opasnosti od bijega jer nisu bile ispunjene zakonske pretpostavke za podnošenje prijedloga.
Prije svega, podsjećamo da je USKOK, nezadovoljan odlukom suda o visini izrečene kazne, podnio žalbu na prvostupanjsku presudu i očekivao da će ona, s obzirom na u njoj iznesene razloge, biti usvojena (izricanje kazne u trajanju od pet godina ili više) u kojem bi slučaju istražni zatvor bio obligatoran.
Nadalje, prema odredbi članka 98. stavka 5. Zakona o kaznenom postupku nakon podizanja optužnice pa do pravomoćnosti odnosno izvršnosti presude mjere opreza određuje, produljuje i ukida prvostupanjski sud. To znači da mjere opreza može izreći, ako su ispunjene pretpostavke, prvostupanjski sud po službenoj dužnosti ili na prijedlog nadležnog državnog odvjetništva.
U konkretnom slučaju, tijekom kaznenog postupka sada pravomoćno osuđeni Zoran Mamić uredno se odazivao sudskim pozivima te nije izbjegavao prijam pismena suda i USKOK-a. Osim toga ima prijavljeno prebivalište i vlasnik je nekretnina u Republici Hrvatskoj gdje žive članovi njegove obitelji i gdje se odvijala njegova poslovna aktivnost zbog koje je često napuštao Republiku Hrvatsku te se u nju vraćao.
Cijeneći sve naprijed navedeno, sama činjenica da imenovani ima i državljanstvo Bosne i Hercegovine koje je ostvario na temelju svog porijekla, ne predstavlja zakonom predviđenu osobitu okolnost opasnosti od bijega iz članka 123. stavka 1. točke 1. Zakona o kaznenom postupku i stoga ne predstavlja dostatan temelj za predlaganje određivanja istražnog zatvora.
