Zadarsko tužiteljstvo žalilo se na presudu Općinskog suda u Zadru kojom je svećenik iz Sali na Dugom otoku, don Tomislav Vlahović, proglašen krivim zbog lažnog predstavljanja i zlouporabe ovlasti prije tri godine kada je, kao policijski kapelan i župnik u Perušiću kod Benkovca, zaustavio automobil s četvoricom lokalnih mladića lažno se predstavljajući kao policajac šibensko-kninske Policijske uprave.
Sutkinja Ana Zrilić proglasila je 33-godišnjeg Vlahovića krivim jer kao kapelan nije imao ovlasti zaustavljati i legitimirati svoje župljane, ali ga je oslobodila kaznene sankcije jer njegovo djelo nema ni žrtve ni posljedice.
- Općinsko državno odvjetništvo u Zadru je, nakon zaprimanja prvostupanjske presude Općinskog suda u Zadru, podnijelo žalbu protiv te presude kojom je sud proglasio hrvatskog državljanina (1987.) krivim zbog počinjenja kaznenog djela protiv javnog reda neovlaštenim obavljanjem službene radnje iz čl. 322. Kaznenog zakona, te ga je oslobodio od kazne. (11. 12. 2020.)
Općinsko državno odvjetništvo u Zadru podnijelo je žalbu protiv takve presude zbog povrede Kaznenog zakona - navodi se u ODO-u.
Sutkinja Zrilić je u obrazloženju presude navela kako je moralna osuda puno veća od one koju propisuje zakon, te da don Tomislav Vlahović nije obična osoba nego svećnik kojega sluša veliki broj ljudi i kao takav bi posebno trebao voditi računa da njegovo ponašanje bude beprijekorno.
Tužiteljstvo je za ovo djelo tražilo kaznu od šest mjeseci zatvora, s rokom kušnje od dvije godine uvjetno.
Takva je kazna dosad izricana za počinitelje puno težih kaznenih djela, poput nasilja u obitelji, a ovo kazneno djelo nema oštećenike, odnosno žrtve, a posljedice su moralne naravi – rekla je sutkinja,
Don Vlahović u sudnici nije želio iznositi svoju obranu, ostao je pri stavu da nije kriv i branio se šutnjom.
Optužen je da je kao kapelan Policijske uprave zadarske zaustavio automobil u kojem su bila četvorica mladića, koji se kretao cestom od Benkovca prema Lepurima, te ih je pokušao legitimirati. Mladići su naveli kako je imao i policijsku palicu. Zaustavio se ispred njihovog automobila te upalio sva četiri svjetla.
Jedan je mladić je tada izjavio kako mu je don Vlahović rekao: »Reci kolegi neka uđe u auto! Nek’ se smiri ili ću ga prebiti i privesti u šibensku policiju«, nakon čega su se vratili u automobil, ali on im je prišao i zatražio osobne iskaznice«.

Zadarsko tužiteljstvo žalilo se na presudu Općinskog suda u Zadru kojom je svećenik iz Sali na Dugom otoku, don Tomislav Vlahović, proglašen krivim zbog lažnog predstavljanja i zlouporabe ovlasti prije tri godine kada je, kao policijski kapelan i župnik u Perušiću kod Benkovca, zaustavio automobil s četvoricom lokalnih mladića lažno se predstavljajući kao policajac šibensko-kninske Policijske uprave.
Sutkinja Ana Zrilić proglasila je 33-godišnjeg Vlahovića krivim jer kao kapelan nije imao ovlasti zaustavljati i legitimirati svoje župljane, ali ga je oslobodila kaznene sankcije jer njegovo djelo nema ni žrtve ni posljedice.
- Općinsko državno odvjetništvo u Zadru je, nakon zaprimanja prvostupanjske presude Općinskog suda u Zadru, podnijelo žalbu protiv te presude kojom je sud proglasio hrvatskog državljanina (1987.) krivim zbog počinjenja kaznenog djela protiv javnog reda neovlaštenim obavljanjem službene radnje iz čl. 322. Kaznenog zakona, te ga je oslobodio od kazne. (11. 12. 2020.)
Općinsko državno odvjetništvo u Zadru podnijelo je žalbu protiv takve presude zbog povrede Kaznenog zakona - navodi se u ODO-u.
Sutkinja Zrilić je u obrazloženju presude navela kako je moralna osuda puno veća od one koju propisuje zakon, te da don Tomislav Vlahović nije obična osoba nego svećnik kojega sluša veliki broj ljudi i kao takav bi posebno trebao voditi računa da njegovo ponašanje bude beprijekorno.
Tužiteljstvo je za ovo djelo tražilo kaznu od šest mjeseci zatvora, s rokom kušnje od dvije godine uvjetno.
Takva je kazna dosad izricana za počinitelje puno težih kaznenih djela, poput nasilja u obitelji, a ovo kazneno djelo nema oštećenike, odnosno žrtve, a posljedice su moralne naravi – rekla je sutkinja,
Don Vlahović u sudnici nije želio iznositi svoju obranu, ostao je pri stavu da nije kriv i branio se šutnjom.
Optužen je da je kao kapelan Policijske uprave zadarske zaustavio automobil u kojem su bila četvorica mladića, koji se kretao cestom od Benkovca prema Lepurima, te ih je pokušao legitimirati. Mladići su naveli kako je imao i policijsku palicu. Zaustavio se ispred njihovog automobila te upalio sva četiri svjetla.
Jedan je mladić je tada izjavio kako mu je don Vlahović rekao: »Reci kolegi neka uđe u auto! Nek’ se smiri ili ću ga prebiti i privesti u šibensku policiju«, nakon čega su se vratili u automobil, ali on im je prišao i zatražio osobne iskaznice«.
