Ustavni je sud pod predsjedanjam suca Rajka Mlinarića ocijenio da su „razlozi za postojanje opasnosti kako bi podnositelj puštanjem na slobodu mogao počiniti nova kaznena djela, a zbog čega se svrha istražnog zatvora u njegovom slučaju ne može ostvariti nekom blažom mjerom, dostatni i relevantni”, pa je odbio ustavnu tužbu jednog od četvorice pritvorenika u slučaju velike plantaže konoplje otkrivene prošlog ljeta na području Islama Grčkog. Policija je tada otkrila 7.728 biljaka konoplje, a krajem studenog četvorici osumnjičenika je Općinski sud produljio istražni zatvor zbog opasnosti od ponavljanja kaznenog djela.

Županijski je sud odbio žalbu na takvo rješenje, a sada je to potvrdio i Ustavni sud smatrajući da su prethodne sudske odluke korektno izrečene iako je po četvrtookrivljenom 44-godišnjaku bila riječ o „arbitrarnom i površnom pristupu sudova u analizi činjenica, okolnosti i navoda relevantnih za donošenje odluke o istražnom zatvoru".

-Što se tiče temeljne pretpostavke za određivanje istražnog zatvora, a to je postojanje osnovane sumnje da je počinjeno kazneno djelo za koje se podnositelj tereti, Ustavni sud utvrđuje da ta sumnja proizlazi iz zapisnika o ispitivanju prvookrivljenika, saslušanih svjedoka, potvrde o privremenom oduzimanju predmeta, zapisnika o očevidu i nalaza toksikološkog vještačenja iz kojih proizlazi da je oduzeto 7.728 biljaka konoplja marihuane ukupne težine 8.860,15 kg za koju je toksikološkim vještačenjem utvrđeno da se radi o opojnoj drogi marihuani, zatim iz zapisnika o prepoznavanju, te iz izuzete bilježnice u kojoj je navedeno kako je tekla proizvodnja i financiranje inkriminirane droge, stoji u odluci Ustavnog suda koji se potom osvrnuo i zadržavanje u pritvoru osumnjičenika zbog opasnosti od ponavljanja djela:

-Ustavni sud utvrđuje da je zaključak sudova o postojanju iteracijske opasnosti utemeljen na činjenici da je podnositelj osuđivana osoba zbog kaznenog djela tjelesne ozljede i da postoji osnovana sumnja da je predmetno kazneno djelo počinjeno u vrijeme provjeravanja po pravomoćnoj presudi. Stoga Ustavni sud zaključuje da ranija osuda i izrečena kazna nisu utjecali na podnositelja u odvraćanju od počinjenja kaznenih djela jer je sada osnovano sumnjiv da je počinio nove protupravne radnje i to u vrijeme provjeravanja iz navedene pravomoćne presude. Uzimajući u obzir i druge utvrđene okolnosti koje upućuju na opasnost od ponavljanja kaznenih djela (pribavljanje novca potrebnog za saniranje gubitaka koji su nastali otkrivanjem ovog kaznenog djela, skromne prihode podnositelja te obvezu uzdržavanja članova svoje obitelji), Ustavni sud ocjenjuje da su u obrazloženjima osporenih rješenja sudovi odgovarajuće analizirali postojanje osobitih okolnosti radi kojih je nužna mjera istražnog zatvora protiv podnositelja, zaključuje Ustavni sud.

Ustavni je sud pod predsjedanjam suca Rajka Mlinarića ocijenio da su „razlozi za postojanje opasnosti kako bi podnositelj puštanjem na slobodu mogao počiniti nova kaznena djela, a zbog čega se svrha istražnog zatvora u njegovom slučaju ne može ostvariti nekom blažom mjerom, dostatni i relevantni”, pa je odbio ustavnu tužbu jednog od četvorice pritvorenika u slučaju velike plantaže konoplje otkrivene prošlog ljeta na području Islama Grčkog. Policija je tada otkrila 7.728 biljaka konoplje, a krajem studenog četvorici osumnjičenika je Općinski sud produljio istražni zatvor zbog opasnosti od ponavljanja kaznenog djela.

Županijski je sud odbio žalbu na takvo rješenje, a sada je to potvrdio i Ustavni sud smatrajući da su prethodne sudske odluke korektno izrečene iako je po četvrtookrivljenom 44-godišnjaku bila riječ o „arbitrarnom i površnom pristupu sudova u analizi činjenica, okolnosti i navoda relevantnih za donošenje odluke o istražnom zatvoru".

-Što se tiče temeljne pretpostavke za određivanje istražnog zatvora, a to je postojanje osnovane sumnje da je počinjeno kazneno djelo za koje se podnositelj tereti, Ustavni sud utvrđuje da ta sumnja proizlazi iz zapisnika o ispitivanju prvookrivljenika, saslušanih svjedoka, potvrde o privremenom oduzimanju predmeta, zapisnika o očevidu i nalaza toksikološkog vještačenja iz kojih proizlazi da je oduzeto 7.728 biljaka konoplja marihuane ukupne težine 8.860,15 kg za koju je toksikološkim vještačenjem utvrđeno da se radi o opojnoj drogi marihuani, zatim iz zapisnika o prepoznavanju, te iz izuzete bilježnice u kojoj je navedeno kako je tekla proizvodnja i financiranje inkriminirane droge, stoji u odluci Ustavnog suda koji se potom osvrnuo i zadržavanje u pritvoru osumnjičenika zbog opasnosti od ponavljanja djela:

-Ustavni sud utvrđuje da je zaključak sudova o postojanju iteracijske opasnosti utemeljen na činjenici da je podnositelj osuđivana osoba zbog kaznenog djela tjelesne ozljede i da postoji osnovana sumnja da je predmetno kazneno djelo počinjeno u vrijeme provjeravanja po pravomoćnoj presudi. Stoga Ustavni sud zaključuje da ranija osuda i izrečena kazna nisu utjecali na podnositelja u odvraćanju od počinjenja kaznenih djela jer je sada osnovano sumnjiv da je počinio nove protupravne radnje i to u vrijeme provjeravanja iz navedene pravomoćne presude. Uzimajući u obzir i druge utvrđene okolnosti koje upućuju na opasnost od ponavljanja kaznenih djela (pribavljanje novca potrebnog za saniranje gubitaka koji su nastali otkrivanjem ovog kaznenog djela, skromne prihode podnositelja te obvezu uzdržavanja članova svoje obitelji), Ustavni sud ocjenjuje da su u obrazloženjima osporenih rješenja sudovi odgovarajuće analizirali postojanje osobitih okolnosti radi kojih je nužna mjera istražnog zatvora protiv podnositelja, zaključuje Ustavni sud.

Ustavni je sud pod predsjedanjam suca Rajka Mlinarića ocijenio da su „razlozi za postojanje opasnosti kako bi podnositelj puštanjem na slobodu mogao počiniti nova kaznena djela, a zbog čega se svrha istražnog zatvora u njegovom slučaju ne može ostvariti nekom blažom mjerom, dostatni i relevantni”, pa je odbio ustavnu tužbu jednog od četvorice pritvorenika u slučaju velike plantaže konoplje otkrivene prošlog ljeta na području Islama Grčkog. Policija je tada otkrila 7.728 biljaka konoplje, a krajem studenog četvorici osumnjičenika je Općinski sud produljio istražni zatvor zbog opasnosti od ponavljanja kaznenog djela.

Županijski je sud odbio žalbu na takvo rješenje, a sada je to potvrdio i Ustavni sud smatrajući da su prethodne sudske odluke korektno izrečene iako je po četvrtookrivljenom 44-godišnjaku bila riječ o „arbitrarnom i površnom pristupu sudova u analizi činjenica, okolnosti i navoda relevantnih za donošenje odluke o istražnom zatvoru".

-Što se tiče temeljne pretpostavke za određivanje istražnog zatvora, a to je postojanje osnovane sumnje da je počinjeno kazneno djelo za koje se podnositelj tereti, Ustavni sud utvrđuje da ta sumnja proizlazi iz zapisnika o ispitivanju prvookrivljenika, saslušanih svjedoka, potvrde o privremenom oduzimanju predmeta, zapisnika o očevidu i nalaza toksikološkog vještačenja iz kojih proizlazi da je oduzeto 7.728 biljaka konoplja marihuane ukupne težine 8.860,15 kg za koju je toksikološkim vještačenjem utvrđeno da se radi o opojnoj drogi marihuani, zatim iz zapisnika o prepoznavanju, te iz izuzete bilježnice u kojoj je navedeno kako je tekla proizvodnja i financiranje inkriminirane droge, stoji u odluci Ustavnog suda koji se potom osvrnuo i zadržavanje u pritvoru osumnjičenika zbog opasnosti od ponavljanja djela:

-Ustavni sud utvrđuje da je zaključak sudova o postojanju iteracijske opasnosti utemeljen na činjenici da je podnositelj osuđivana osoba zbog kaznenog djela tjelesne ozljede i da postoji osnovana sumnja da je predmetno kazneno djelo počinjeno u vrijeme provjeravanja po pravomoćnoj presudi. Stoga Ustavni sud zaključuje da ranija osuda i izrečena kazna nisu utjecali na podnositelja u odvraćanju od počinjenja kaznenih djela jer je sada osnovano sumnjiv da je počinio nove protupravne radnje i to u vrijeme provjeravanja iz navedene pravomoćne presude. Uzimajući u obzir i druge utvrđene okolnosti koje upućuju na opasnost od ponavljanja kaznenih djela (pribavljanje novca potrebnog za saniranje gubitaka koji su nastali otkrivanjem ovog kaznenog djela, skromne prihode podnositelja te obvezu uzdržavanja članova svoje obitelji), Ustavni sud ocjenjuje da su u obrazloženjima osporenih rješenja sudovi odgovarajuće analizirali postojanje osobitih okolnosti radi kojih je nužna mjera istražnog zatvora protiv podnositelja, zaključuje Ustavni sud.
