Čak 74.867.808,34 kuna iznosi ukupan dug tvrtke za preradu ribe "Ostrea" iz Stankovaca koja je otišla u stečaj prije tri godine, nakon što je 2018. zbog gospodarskog kriminala teškog više desetaka milijuna kuna uhićen njezin nekadašnji vlasnik i direktor Neven Badurina. Zbog različitih djela gospodarskog kriminala s njim su kazneno prijavljeni i Valentino Lukinec i Hrvoje Butković. Iz tvrtke su izvukli nešto više od 48 milijuna kuna, a državni proračun RH oštećen je za dodatnih 19 milijuna kuna. 

Od ukupnog iznosa duga tvrtke, na skupštini vjerovnika održanoj 9. veljače na Trgovačkom sudu u Zadru pod predsjedanjem sutkinje Ardene Bajlo, utvrđeno je da dug 'Ostree' prema državi iznosi 4.138.272,35 kuna, a prema Hrvatskoj poštanskoj banci 55.937.845,55 kuna.

Stečajni upravitelj 'Ostree' Željko Vrkić na Skupštini vjerovnika naveo je kako je situacija znatno složenija od toga što bi se moglo isčitati iz nacrta tužbenih zahtjeva za postupke o kojima se prvi put odlučivalo na skupštini u svibnju 2021. te smatra da je u međuvremenu došlo do zastare za neke od njih.

Njegovi prijedlozi za pokretanjem sudskih postupaka radi naplate potraživanja od Ostreinih dužnika – tvrtki 'Parma fish' d.o.o., Split, 'Hladnjače Benkovac' d.o.o, tvrtke 'Rent a Mat'e d.o.o. Zagreb, te 'Fiduaciarie Emiliniane' spa Italija nisu prihvaćeni.

U odnosu na postupak prema Parma fishu, tvrtki koja je 2018.godine službeno preuzela 'Ostreinu' prozvodnju, te se od nje traži 30 milijuna kuna za nekretninu, naveo je da bi prema njegovom mišljenju tužbeni zahtjev bio u zastari, a da bi tužbeni zahtjev vezan za raskid ugovora bio skopčan s daljnjim problemima jer je riječ o nekretnini koja je opterećena razlučnim pravima.

Smatra da bi se vraćanjem te nekretnine u posjed samo održalo postojeće stanje jer bi se naplatio HPB u jednoj ili u drugoj varijanti, što ne bi druge vjerovnike dovelo u bolji položaj s obzirom da je riječ o nekretnini koja je opterećena razlučnim pravima u korist HPB-a.

Na njegov prijedlog za pokretanje postupka protiv te tvrtke bili su suzdržani i HPB, koju zastupa zagrebački odvjetnik Damir Kevilj, i država koju zastupa zamjenica u Županijskom državnom odvjetništvu u Zadru Svetlana Barešić.

U odnosu na eventualni postupak prema zagrebačkoj tvrtki Rent a Mate j.d.o.o. kojoj su prodana 'Ostreina' vozila stečajni upravitelj Vrkić je naveo kako se u međuvremenu promijenio osnivački ugovor, te osoba ovlaštena za zastupanje, kao i sjedište koje je sada u Zagrebu. Posebno je naveo kako do stvarne primopredaje između njega kao stečajnog upravitelja i posljednje osobe ovlaštene za zastupanje nije bilo, jer je to zadnji direktor 'Ostree' Petar Kovačević, kojeg je imenovao badurina, izbjegavao, pa je opreza radi naveo da je moguće da su kod njega i pečati 'Ostree' kojima bi se mogle krivotvoriti činjenice vezane za plaćanje vozila.

Predložio je raskid ugovora s 'Hladnjačom Benkovac' i povrat nekretnine, navodeći kako tražbina nije u zastari barem ne u dijelu od 2.217.520,00 kuna s obzirom da je trebala biti plaćena do 30. lipnja 2019. Država je glasala za taj prijedlog, a HPB je bio protiv navodeći kako je riječ o zastari, te da postoji i potreba predujmljivanja znatnih troškova za čije podmirivanje za sada nema sredstava.

Čak 74.867.808,34 kuna iznosi ukupan dug tvrtke za preradu ribe "Ostrea" iz Stankovaca koja je otišla u stečaj prije tri godine, nakon što je 2018. zbog gospodarskog kriminala teškog više desetaka milijuna kuna uhićen njezin nekadašnji vlasnik i direktor Neven Badurina. Zbog različitih djela gospodarskog kriminala s njim su kazneno prijavljeni i Valentino Lukinec i Hrvoje Butković. Iz tvrtke su izvukli nešto više od 48 milijuna kuna, a državni proračun RH oštećen je za dodatnih 19 milijuna kuna. 

Od ukupnog iznosa duga tvrtke, na skupštini vjerovnika održanoj 9. veljače na Trgovačkom sudu u Zadru pod predsjedanjem sutkinje Ardene Bajlo, utvrđeno je da dug 'Ostree' prema državi iznosi 4.138.272,35 kuna, a prema Hrvatskoj poštanskoj banci 55.937.845,55 kuna.

Stečajni upravitelj 'Ostree' Željko Vrkić na Skupštini vjerovnika naveo je kako je situacija znatno složenija od toga što bi se moglo isčitati iz nacrta tužbenih zahtjeva za postupke o kojima se prvi put odlučivalo na skupštini u svibnju 2021. te smatra da je u međuvremenu došlo do zastare za neke od njih.

Njegovi prijedlozi za pokretanjem sudskih postupaka radi naplate potraživanja od Ostreinih dužnika – tvrtki 'Parma fish' d.o.o., Split, 'Hladnjače Benkovac' d.o.o, tvrtke 'Rent a Mat'e d.o.o. Zagreb, te 'Fiduaciarie Emiliniane' spa Italija nisu prihvaćeni.

U odnosu na postupak prema Parma fishu, tvrtki koja je 2018.godine službeno preuzela 'Ostreinu' prozvodnju, te se od nje traži 30 milijuna kuna za nekretninu, naveo je da bi prema njegovom mišljenju tužbeni zahtjev bio u zastari, a da bi tužbeni zahtjev vezan za raskid ugovora bio skopčan s daljnjim problemima jer je riječ o nekretnini koja je opterećena razlučnim pravima.

Smatra da bi se vraćanjem te nekretnine u posjed samo održalo postojeće stanje jer bi se naplatio HPB u jednoj ili u drugoj varijanti, što ne bi druge vjerovnike dovelo u bolji položaj s obzirom da je riječ o nekretnini koja je opterećena razlučnim pravima u korist HPB-a.

Na njegov prijedlog za pokretanje postupka protiv te tvrtke bili su suzdržani i HPB, koju zastupa zagrebački odvjetnik Damir Kevilj, i država koju zastupa zamjenica u Županijskom državnom odvjetništvu u Zadru Svetlana Barešić.

U odnosu na eventualni postupak prema zagrebačkoj tvrtki Rent a Mate j.d.o.o. kojoj su prodana 'Ostreina' vozila stečajni upravitelj Vrkić je naveo kako se u međuvremenu promijenio osnivački ugovor, te osoba ovlaštena za zastupanje, kao i sjedište koje je sada u Zagrebu. Posebno je naveo kako do stvarne primopredaje između njega kao stečajnog upravitelja i posljednje osobe ovlaštene za zastupanje nije bilo, jer je to zadnji direktor 'Ostree' Petar Kovačević, kojeg je imenovao badurina, izbjegavao, pa je opreza radi naveo da je moguće da su kod njega i pečati 'Ostree' kojima bi se mogle krivotvoriti činjenice vezane za plaćanje vozila.

Predložio je raskid ugovora s 'Hladnjačom Benkovac' i povrat nekretnine, navodeći kako tražbina nije u zastari barem ne u dijelu od 2.217.520,00 kuna s obzirom da je trebala biti plaćena do 30. lipnja 2019. Država je glasala za taj prijedlog, a HPB je bio protiv navodeći kako je riječ o zastari, te da postoji i potreba predujmljivanja znatnih troškova za čije podmirivanje za sada nema sredstava.

Ukupan dug bivše tvornice za preradu ribe ‘Ostrea‘ veći od 74 milijuna kuna: naplata od dijela najvećih dužnika nije prihvaćena!

Čak 74.867.808,34 kuna iznosi ukupan dug tvrtke za preradu ribe "Ostrea" iz Stankovaca koja je otišla u stečaj prije tri godine, nakon što je 2018. zbog gospodarskog kriminala teškog više desetaka milijuna kuna uhićen njezin nekadašnji vlasnik i direktor Neven Badurina. Zbog različitih djela gospodarskog kriminala s njim su kazneno prijavljeni i Valentino Lukinec i Hrvoje Butković. Iz tvrtke su izvukli nešto više od 48 milijuna kuna, a državni proračun RH oštećen je za dodatnih 19 milijuna kuna. 

Od ukupnog iznosa duga tvrtke, na skupštini vjerovnika održanoj 9. veljače na Trgovačkom sudu u Zadru pod predsjedanjem sutkinje Ardene Bajlo, utvrđeno je da dug 'Ostree' prema državi iznosi 4.138.272,35 kuna, a prema Hrvatskoj poštanskoj banci 55.937.845,55 kuna.

Stečajni upravitelj 'Ostree' Željko Vrkić na Skupštini vjerovnika naveo je kako je situacija znatno složenija od toga što bi se moglo isčitati iz nacrta tužbenih zahtjeva za postupke o kojima se prvi put odlučivalo na skupštini u svibnju 2021. te smatra da je u međuvremenu došlo do zastare za neke od njih.

Njegovi prijedlozi za pokretanjem sudskih postupaka radi naplate potraživanja od Ostreinih dužnika – tvrtki 'Parma fish' d.o.o., Split, 'Hladnjače Benkovac' d.o.o, tvrtke 'Rent a Mat'e d.o.o. Zagreb, te 'Fiduaciarie Emiliniane' spa Italija nisu prihvaćeni.

U odnosu na postupak prema Parma fishu, tvrtki koja je 2018.godine službeno preuzela 'Ostreinu' prozvodnju, te se od nje traži 30 milijuna kuna za nekretninu, naveo je da bi prema njegovom mišljenju tužbeni zahtjev bio u zastari, a da bi tužbeni zahtjev vezan za raskid ugovora bio skopčan s daljnjim problemima jer je riječ o nekretnini koja je opterećena razlučnim pravima.

Smatra da bi se vraćanjem te nekretnine u posjed samo održalo postojeće stanje jer bi se naplatio HPB u jednoj ili u drugoj varijanti, što ne bi druge vjerovnike dovelo u bolji položaj s obzirom da je riječ o nekretnini koja je opterećena razlučnim pravima u korist HPB-a.
