U Županijski sud u Rijeci stigla je presuda Vrhovnog suda kojom se poništava oslobađajuća presuda riječkog suda Valteru Flegi od optužbi za zloporabu položaja i pribavljanje imovinske koristi u vrijeme dok je bio gradonačelnik Buzeta, potvrđeno je u ponedjeljak iz Županijskog suda.

Suđenje se vraća na početak. 

Bivšem gradonačelniku Buzeta i istarskom županu, a sadašnjem zastupniku IDS-a u Europskom parlamentu, Valteru Flegu na Županijskom suda u Rijeci se sudilo pod optužbom da je kao gradonačelnik Buzeta zlorabio položaj i ovlasti, nezakonito povećavši plaće sebi i svojim suradnicima i tako oštetio gradski proračun za više od pola milijuna kuna.

Nepravomoćnu oslobađajuću presudu donijelo je sudsko vijeće riječkog Županijsjkog suda, kojim je predsjedavao sudac Saša Cvijetić. U obrazloženju presude istaknuo je kako nije dokazano da je Flego zlorabio položaj i ovlasti da bi stvorio sebi i suradnicima korist te da bi nanio štetu gradu Buzetu.

Odluke o povećanju plaća donijete su temeljem mišljenja stručnih službi Grada, posebno pravne, te je utvrđeno da je riječ o zakonitom postupku. Te odluke su bile javne, kazao je sudac Cvijetić. Dodao je kako je upitno je li tim povećanjima plaća ostvarena dodatna imovinska korist Flegi i suradnicima, s obzirom na to da su imali stvarnih troškova, koje si nisu dulje vrijeme isplaćivali.

Uskok je optužio Valtera Flegu da je zlouporabom položaja i ovlasti kao gradonačelnik Buzeta, od 11. ožujka 2010. do 30. svibnja 2013. sebi i svojim suradnicima, zamjeniku buzetskog gradonačelnika, predstojniku Ureda gradonačelnika i trima pročelnicima upravnih tijela Grada, nezakonito povisio plaće.

Time je Flego sebi, naveo je u optužbi Uskok, nezakonito priskrbio 66.000 kuna.

Isplatu povećanih plaća, prema tvrdnjama tužiteljstva, omogućio je donošenjem Pravilnika o radu Uprave grada Buzeta i to protivno Zakonu o plaćama u regionalnoj samoupravi. Prema tom pravilniku mu je plaća uvećana za pet posto zbog stjecanja znanstvenog stupnja magistra znanosti i 15 posto za troškove pripreme za sudjelovanje u protokolarnim događajima.

Za troškove pripreme za sudjelovanje u protokolarnim događajima, zamjeniku gradonačelnika plaća je uvećana za 15 posto, a ostalim suradnicima za po 10 posto.

Prema pisanju medija, Vrhovni sud je ocijenio da dokazi u suđenju na Županijskom sudu u Rijeci nisu sagledani pomno u cijelosti te da su učinjeni još neki propusti.

U Županijski sud u Rijeci stigla je presuda Vrhovnog suda kojom se poništava oslobađajuća presuda riječkog suda Valteru Flegi od optužbi za zloporabu položaja i pribavljanje imovinske koristi u vrijeme dok je bio gradonačelnik Buzeta, potvrđeno je u ponedjeljak iz Županijskog suda.

Suđenje se vraća na početak. 

Bivšem gradonačelniku Buzeta i istarskom županu, a sadašnjem zastupniku IDS-a u Europskom parlamentu, Valteru Flegu na Županijskom suda u Rijeci se sudilo pod optužbom da je kao gradonačelnik Buzeta zlorabio položaj i ovlasti, nezakonito povećavši plaće sebi i svojim suradnicima i tako oštetio gradski proračun za više od pola milijuna kuna.

Nepravomoćnu oslobađajuću presudu donijelo je sudsko vijeće riječkog Županijsjkog suda, kojim je predsjedavao sudac Saša Cvijetić. U obrazloženju presude istaknuo je kako nije dokazano da je Flego zlorabio položaj i ovlasti da bi stvorio sebi i suradnicima korist te da bi nanio štetu gradu Buzetu.

Odluke o povećanju plaća donijete su temeljem mišljenja stručnih službi Grada, posebno pravne, te je utvrđeno da je riječ o zakonitom postupku. Te odluke su bile javne, kazao je sudac Cvijetić. Dodao je kako je upitno je li tim povećanjima plaća ostvarena dodatna imovinska korist Flegi i suradnicima, s obzirom na to da su imali stvarnih troškova, koje si nisu dulje vrijeme isplaćivali.

Uskok je optužio Valtera Flegu da je zlouporabom položaja i ovlasti kao gradonačelnik Buzeta, od 11. ožujka 2010. do 30. svibnja 2013. sebi i svojim suradnicima, zamjeniku buzetskog gradonačelnika, predstojniku Ureda gradonačelnika i trima pročelnicima upravnih tijela Grada, nezakonito povisio plaće.

Time je Flego sebi, naveo je u optužbi Uskok, nezakonito priskrbio 66.000 kuna.

Isplatu povećanih plaća, prema tvrdnjama tužiteljstva, omogućio je donošenjem Pravilnika o radu Uprave grada Buzeta i to protivno Zakonu o plaćama u regionalnoj samoupravi. Prema tom pravilniku mu je plaća uvećana za pet posto zbog stjecanja znanstvenog stupnja magistra znanosti i 15 posto za troškove pripreme za sudjelovanje u protokolarnim događajima.

Za troškove pripreme za sudjelovanje u protokolarnim događajima, zamjeniku gradonačelnika plaća je uvećana za 15 posto, a ostalim suradnicima za po 10 posto.

Prema pisanju medija, Vrhovni sud je ocijenio da dokazi u suđenju na Županijskom sudu u Rijeci nisu sagledani pomno u cijelosti te da su učinjeni još neki propusti.
