Sredinom lanjskog svibnja stručno tijelo Ministarstva mora, prometa i infrastrukture donijelo je odluku o dodjeli koncesije nad korištenjem plaže u uvali Žnjan.

Na natječaj su pristigle tri ponude, jedna od trgovačkog društva "Mehatronika Burazin" d.o.o., trgovačkog društva "AdriaticBooking" j.d.o.o. i trgovačkog društva "Žnjan" d.o.o. Nakon pregleda i analize cjelokupne dokumentacije svih pristiglih ponuda, odluka je pala da poduzeće "Žnjan" – "dobije" Žnjan.

Odluka je, po pojašnjenju stručnog tijela, bila jednostavna – koncesiju je dobio onaj koji je jedini ispunio sve natječajem propisane uvjete. Stoga je Ministarstvo mora, prometa i infrastrukture predložilo Vladi Republike Hrvatske donošenje odluke o dodjeli koncesije na pomorskom dobru, a u svrhu izgradnje i gospodarskog korištenja plaže u uvali Žnjan.

I time je, vjerovali su mnogi, stvar riješena. Ali, nije. Pred Upravnim sudom u Splitu, u sudnici sutkinje Sande Crljen Ivančić, održano je ročište na kojem su predstavnici tvrtki "AdriaticBooking" i "Mehatronika Burazin" pokušali dokazati kako su nepravedno i protuzakonito "ispali" iz natječaja, tužeći pritom Vladu Republike Hrvatske.

Brojne nepravilnosti

Predstavnik "AdriaticBookinga", odvjetnik Davor Vidović, predložio je Sudu da sasluša vlasnika tvrtke Srđana Javorčića, s čime se složio i odvjetnik "Mehatronike Burazin" Zoran Zović, dodajući kako bi se trebalo saslušati i Tomislava Burazina, vlasnika te tvrtke. Oni imaju direktna saznanja o procesu otvaranja ponuda, kojem su prisustvovali, kao i tijeku postupka koji je tome prethodio.

– Javnost preko medijskih napisa uzima zdravo za gotovo da je koncesija dana "Žnjanu" gotova stvar, a prate je brojne nepravilnosti i nezakonitosti koje su detaljno obrazložene u tužbi – kazao je, među ostalim, odvjetnik Vidović.

Zatražio je privremenu mjeru kojom se zabranjuje tuženiku (Vladi) i tvrtki "Žnjan" da sklope ugovor o koncesiji pomorskog dobra. Protuustavnim je odvjetnik Zović nazvao osiguranje temeljnog kapitala tvrtke "Žnjan" – javnim novcem, s obzirom kako je Grad Split jedini vlasnik i osnivač tvrtke, pa je time stupio u poduzetničke i tržišne vode, što nije propisana uloga Grada, tvrdeći kako je njegov klijent u posjedu dviju lokacijskih dozvola za Žnjan, što nitko drugi nema.

Dodao je i kako je procijenjena vrijednost koncesije od 5,35 milijuna eura mnogostruko veća. Nazvao je i objavu o namjeri davanja u koncesiju nezakonitom jer se nije prije svega najavila Uredu Europske unije za publikacije.

– Predmet koncesije nije samo plaža, već bi koncesionar imao i pravo i obavezu izgraditi ugostiteljske i sportske objekte, kao i podzemnu garažu na ostatku prostora – kazao je Zović.

Radovi će krenuti

Zamjenica županijske državne odvjetnice Maja Klement predstavljala je Republiku Hrvatsku na ročištu i osporila je sve navode odvjetnika tužitelja, tražeći da sutkinja odbije tužbene zahtjeve kao neosnovane.

Sutkinja Crljen Ivančić sve je izrečeno primila na znanje i izvijestit će sve strane u postupku o svojim daljnjim namjerama i odlukama.

Kako bilo, mi neslužbeno doznajemo da ovaj sudski proces ne može i neće utjecati na ritam planiranih radova na Žnjanu. Kada i ako do njih dođe u skoro vrijeme.

Doznajemo isto tako kako je ponuda tvrtke "AdriaticBooking" bila čak i bolja od ponude tvrtke "Žnjan", no nedostajao joj je jedan dokument i time je zbog nepotpunosti dokumentacije izbačena iz razmatranja. Tvrtki "Mehatronika Burazin" nedostajalo je ipak više dokumenata.

Uvjeti koncesije: Dužni su uložiti 225,6 milijuna kuna

 

Koncesiju na plažu Žnjan u trajanju od 40 godina istoimena je tvrtka dobila nad ukupnom površinom pomorskog dobra od 218.322 četvorna metra. Dužni su ukupno uložiti 225,6 milijuna kuna.

Stalni dio naknade za koncesiju je pet kuna po metru četvornome zauzete ukupne površine pomorskog dobra godišnje, što je 1,09 milijuna kuna godišnje, s time da će se nakon desete godine povećavati svakih pet godina za 0,5 kuna po kvadratu, što za sve vrijeme koncesije iznosi 54,6 milijuna kuna.

Sredinom lanjskog svibnja stručno tijelo Ministarstva mora, prometa i infrastrukture donijelo je odluku o dodjeli koncesije nad korištenjem plaže u uvali Žnjan.

Na natječaj su pristigle tri ponude, jedna od trgovačkog društva "Mehatronika Burazin" d.o.o., trgovačkog društva "AdriaticBooking" j.d.o.o. i trgovačkog društva "Žnjan" d.o.o. Nakon pregleda i analize cjelokupne dokumentacije svih pristiglih ponuda, odluka je pala da poduzeće "Žnjan" – "dobije" Žnjan.

Odluka je, po pojašnjenju stručnog tijela, bila jednostavna – koncesiju je dobio onaj koji je jedini ispunio sve natječajem propisane uvjete. Stoga je Ministarstvo mora, prometa i infrastrukture predložilo Vladi Republike Hrvatske donošenje odluke o dodjeli koncesije na pomorskom dobru, a u svrhu izgradnje i gospodarskog korištenja plaže u uvali Žnjan.

I time je, vjerovali su mnogi, stvar riješena. Ali, nije. Pred Upravnim sudom u Splitu, u sudnici sutkinje Sande Crljen Ivančić, održano je ročište na kojem su predstavnici tvrtki "AdriaticBooking" i "Mehatronika Burazin" pokušali dokazati kako su nepravedno i protuzakonito "ispali" iz natječaja, tužeći pritom Vladu Republike Hrvatske.

Brojne nepravilnosti

Predstavnik "AdriaticBookinga", odvjetnik Davor Vidović, predložio je Sudu da sasluša vlasnika tvrtke Srđana Javorčića, s čime se složio i odvjetnik "Mehatronike Burazin" Zoran Zović, dodajući kako bi se trebalo saslušati i Tomislava Burazina, vlasnika te tvrtke. Oni imaju direktna saznanja o procesu otvaranja ponuda, kojem su prisustvovali, kao i tijeku postupka koji je tome prethodio.

– Javnost preko medijskih napisa uzima zdravo za gotovo da je koncesija dana "Žnjanu" gotova stvar, a prate je brojne nepravilnosti i nezakonitosti koje su detaljno obrazložene u tužbi – kazao je, među ostalim, odvjetnik Vidović.

Zatražio je privremenu mjeru kojom se zabranjuje tuženiku (Vladi) i tvrtki "Žnjan" da sklope ugovor o koncesiji pomorskog dobra. Protuustavnim je odvjetnik Zović nazvao osiguranje temeljnog kapitala tvrtke "Žnjan" – javnim novcem, s obzirom kako je Grad Split jedini vlasnik i osnivač tvrtke, pa je time stupio u poduzetničke i tržišne vode, što nije propisana uloga Grada, tvrdeći kako je njegov klijent u posjedu dviju lokacijskih dozvola za Žnjan, što nitko drugi nema.

Dodao je i kako je procijenjena vrijednost koncesije od 5,35 milijuna eura mnogostruko veća. Nazvao je i objavu o namjeri davanja u koncesiju nezakonitom jer se nije prije svega najavila Uredu Europske unije za publikacije.

– Predmet koncesije nije samo plaža, već bi koncesionar imao i pravo i obavezu izgraditi ugostiteljske i sportske objekte, kao i podzemnu garažu na ostatku prostora – kazao je Zović.

Radovi će krenuti

Zamjenica županijske državne odvjetnice Maja Klement predstavljala je Republiku Hrvatsku na ročištu i osporila je sve navode odvjetnika tužitelja, tražeći da sutkinja odbije tužbene zahtjeve kao neosnovane.

Sutkinja Crljen Ivančić sve je izrečeno primila na znanje i izvijestit će sve strane u postupku o svojim daljnjim namjerama i odlukama.

Kako bilo, mi neslužbeno doznajemo da ovaj sudski proces ne može i neće utjecati na ritam planiranih radova na Žnjanu. Kada i ako do njih dođe u skoro vrijeme.

Doznajemo isto tako kako je ponuda tvrtke "AdriaticBooking" bila čak i bolja od ponude tvrtke "Žnjan", no nedostajao joj je jedan dokument i time je zbog nepotpunosti dokumentacije izbačena iz razmatranja. Tvrtki "Mehatronika Burazin" nedostajalo je ipak više dokumenata.

Uvjeti koncesije: Dužni su uložiti 225,6 milijuna kuna

 

Koncesiju na plažu Žnjan u trajanju od 40 godina istoimena je tvrtka dobila nad ukupnom površinom pomorskog dobra od 218.322 četvorna metra. Dužni su ukupno uložiti 225,6 milijuna kuna.

Stalni dio naknade za koncesiju je pet kuna po metru četvornome zauzete ukupne površine pomorskog dobra godišnje, što je 1,09 milijuna kuna godišnje, s time da će se nakon desete godine povećavati svakih pet godina za 0,5 kuna po kvadratu, što za sve vrijeme koncesije iznosi 54,6 milijuna kuna.
