Sudovi su u protekla dva tjedna objavili 30 presuda u kojima su okrivljeni oslobođeni u povodu optužnog prijedloga Hrvatske radiotelevizije, iako su ih njihovi kontrolori zatekli s neprijavljenim TV prijamnicima, piše Večernji list.

Za taj prekršaj Zakon o HRT-u prijeti kaznom od 130 eura (1000 kn). U svim predmetima kod 11 sudaca obrazloženo je da HRT nije dostavio podatak kad je kupljen TV prijamnik jer prekršaj čini onaj tko u 30-dnevnom roku od nabave prijamnik ne prijavi HRT-u. To je nužno utvrditi kako bi se utvrdilo točno vrijeme počinjenja prekršaja, od kada teče i zastarni rok. To je odlučna činjenica bez koje prekršaja nema, u bitnome suci tumače isto.

Naravno, okrivljenik neće govoriti protiv sebe. Zato sutkinja Iva Šiprak u jednom predmetu obrazlaže: "Ne može se ni očekivati da je tu činjenicu moguće utvrditi."

Sutkinja Ivana Bosnić-Kovačić u svome predmetu tumači da HRT ne može mijenjati podatak o vremenu izvršenja prekršaja tako da rok od 30 dana počinje teći od dana kontrole. "To bi jedino bilo opravdano u slučaju kada bi dan kontrole bio dan nabave prijamnika, što u optužnom prijedlogu nije navedeno", obrazložila je i HRT uputila na parnicu sa zahtjevom od 223 eura za neplaćenu preplatu.

Odbila im je i zahtjev za isplatu troška od 170 eura obrazlažući da HRT nema pravo na naknadu nagrade i stvarnih troškova opunomoćenika - odvjetničkog društva Leko i partneri, koje je u većini slučajeva zastupalo HRT, dok ga je tek u nekima zastupalo društvo Hanžeković i partneri. Troškovi okrivljenika i sudski troškovi padaju na teret državnog proračuna, piše Večernji list, a prenosi HINA.

Naknadno Index dobio priopćenje HRT-a, u kojem se navodi:

"Netočno je da je cjelokupna sudska praksa svih sudova u RH oslobađajuća za obveznike u prekršajnim postupcima.

Činjenica da Hrvatska radiotelevizija nije uspjela u konkretnim prekršajnim postupcima dokazati krivnju fizičke osobe za prekršaj prema članku 47. Zakona o Hrvatskoj radioteleviziji, ne utječe na mogućnost Hrvatske radiotelevizije da od te osobe naplati dužan iznos pristojbe u parničnom postupku za naknadu štete, ovo prije svega budući da je materijalno pravna odgovornost za štetu puno šira nego prekršajnopravna.

HRT preispituje dosadašnju praksu pokretanja prekršajnih postupaka na način da analizira uspješnost pokretanja optužnih prijedloga, te pokreće postupke s velikom šansom za uspjeh. Također, netočno je da trošak prekršajnog postupka HRT košta 170 Eura.

Što se tiče izmjene propisa, isto ne možemo komentirati budući da je to izvan ovlasti same Hrvatske radiotelevizije."

Sudovi su u protekla dva tjedna objavili 30 presuda u kojima su okrivljeni oslobođeni u povodu optužnog prijedloga Hrvatske radiotelevizije, iako su ih njihovi kontrolori zatekli s neprijavljenim TV prijamnicima, piše Večernji list.

Za taj prekršaj Zakon o HRT-u prijeti kaznom od 130 eura (1000 kn). U svim predmetima kod 11 sudaca obrazloženo je da HRT nije dostavio podatak kad je kupljen TV prijamnik jer prekršaj čini onaj tko u 30-dnevnom roku od nabave prijamnik ne prijavi HRT-u. To je nužno utvrditi kako bi se utvrdilo točno vrijeme počinjenja prekršaja, od kada teče i zastarni rok. To je odlučna činjenica bez koje prekršaja nema, u bitnome suci tumače isto.

Naravno, okrivljenik neće govoriti protiv sebe. Zato sutkinja Iva Šiprak u jednom predmetu obrazlaže: "Ne može se ni očekivati da je tu činjenicu moguće utvrditi."

Sutkinja Ivana Bosnić-Kovačić u svome predmetu tumači da HRT ne može mijenjati podatak o vremenu izvršenja prekršaja tako da rok od 30 dana počinje teći od dana kontrole. "To bi jedino bilo opravdano u slučaju kada bi dan kontrole bio dan nabave prijamnika, što u optužnom prijedlogu nije navedeno", obrazložila je i HRT uputila na parnicu sa zahtjevom od 223 eura za neplaćenu preplatu.

Odbila im je i zahtjev za isplatu troška od 170 eura obrazlažući da HRT nema pravo na naknadu nagrade i stvarnih troškova opunomoćenika - odvjetničkog društva Leko i partneri, koje je u većini slučajeva zastupalo HRT, dok ga je tek u nekima zastupalo društvo Hanžeković i partneri. Troškovi okrivljenika i sudski troškovi padaju na teret državnog proračuna, piše Večernji list, a prenosi HINA.

Naknadno Index dobio priopćenje HRT-a, u kojem se navodi:

"Netočno je da je cjelokupna sudska praksa svih sudova u RH oslobađajuća za obveznike u prekršajnim postupcima.

Činjenica da Hrvatska radiotelevizija nije uspjela u konkretnim prekršajnim postupcima dokazati krivnju fizičke osobe za prekršaj prema članku 47. Zakona o Hrvatskoj radioteleviziji, ne utječe na mogućnost Hrvatske radiotelevizije da od te osobe naplati dužan iznos pristojbe u parničnom postupku za naknadu štete, ovo prije svega budući da je materijalno pravna odgovornost za štetu puno šira nego prekršajnopravna.

HRT preispituje dosadašnju praksu pokretanja prekršajnih postupaka na način da analizira uspješnost pokretanja optužnih prijedloga, te pokreće postupke s velikom šansom za uspjeh. Također, netočno je da trošak prekršajnog postupka HRT košta 170 Eura.

Što se tiče izmjene propisa, isto ne možemo komentirati budući da je to izvan ovlasti same Hrvatske radiotelevizije."
