Prijatelj mi je ovog ljeta, u jednoj dobro zaštićenoj uvali, od pomorske policije dobio prekršajni nalog s opisom prekršaja: Prilikom kontrole utvrđeno je da je isti usidren i istovremeno vezan na obalu. Time je navodno počinio prekršaj iz članka 133. Pomorskog zakonika i dobio kaznu od 3000 kuna, premda u tom članku takav prekršaj uopće nije opisan. Osim toga, nije mi jasno kako se to bez sidrenja uopće može privezati uz neuređenu obalu. Aljoša G., Zagreb

 

Ne postoji nikakav zakon koji zabranjuje usidrenom plovilu da istovremeno bude vezano na obalu. U suprotnom, nitko tko plovilom ode u neku uvalu, na kupanje, na izlet ili obrađivati imanje, ne bi mogao iz svog plovila izići na obalu. Osim toga, plovilo vezivanjem uz obalu zauzima manje mjesta nego u slučaju slobodnog okretanja oko sidra, dakle, u uvali ima mjesta za više plovila, a u središnjem dijelu uvale i više prostora za manevriranje. Postojanjem takvog zakona bi se u nekim popularnim privezištima ili lukama, primjerice luka Hvar, plovila uz obalu mogla privezati isključivo bokom, što je nelogično, a s obzirom na otvorenost te luke za manja plovila i opasno.

Faktor sigurnosti

Jednako tako, nisu točna ni tumačenja da plovilo može biti privezano isključivo u luci ili dijelovima luke opremljenim napravama za privezivanje, premda Pravilnik o uvjetima i načinu održavanja reda u lukama i na ostalim dijelovima unutarnjih morskih voda i teritorijalnog mora RH, u stavku 1. članka 52., to propisuje. Naime, već sljedeći stavak, stavak 2., istog članka, a koji glasi: Iznimno od stavka 1. ovoga članka plovni objekt može biti privezan izvan luke isključivo na način da ne ugrožava sigurnost plovidbe, ljudske živote, imovinu, obalu i morski okoliš – to dozvoljava.

Dakle, plovilo može biti usidreno i istovremeno vezano na obalu, ali na način da ne ugrožava sigurnost plovidbe, o čemu govori i spomenuti članak 133. PZ-a prema kojem je vaš prijatelj kažnjen. Isti članak, pod istim brojem, bio je i u ranijem Pomorskom zakoniku, ali se po njemu ovakve prekršaje do sada nije kažnjavalo, vjerojatno jer ranije nisu bili ovako učestala pojava kao danas.

Problem se uglavnom javlja s većim plovilima koja se zbog svoga gaza ne mogu približiti bliže obali. Sidra su gotovo svima oborena s pramca, a približavanjem obali mogu ošteti kormila i propelere. Tako udaljeni od obale, a kako se ne bi okretali, jednim ili s više krmenih konopa se privežu za obalu, neki čak i dodatno po boku ili pramcu. Zvuči nevjerojatno, ali ponekad su ti konopi razvučeni i preko 50 metara. Ovakvo vezivanje čini zapreku i svakako ugrožava sigurnost plovidbe, naročito onima koji zaplove između njih i obale ili u uvalu i uz obalu uplovljavaju noću.

Mogućnost žalbe

Pravilo koje brani sidrenje uz vezivanje na obalu ne postoji, ali ovo o ugrožavanju sigurnosti plovidbe svakako da. Slijedom toga nema ni pravila koje definira koliko tako vezano plovilo može biti udaljeno od obale, već je to stvar zdravog razuma i slobodne procjene. Uzrok ovom nesporazumu vjerojatno je način na koji je prekršaj opisan. Možda bi bilo bolje da je još dopisano …čime ugrožava sigurnost plovidbe. Ukoliko je vaš prijatelj mišljenja kako nije ugrozio sigurnost plovidbe, tada je trebao to navesti u prekršajnom postupku i osigurati dokaze za koje smatra da je u pravu, pa prema navedenom u roku 8 dana nadležnom sudu uložiti prigovor.

Inače, novčana kazna predviđena za ovaj prekršaj iznosi od 3000 do 50.000 kuna, a ako se plati u roku 8 dana tada je umanjena na 2/3 izrečenog iznosa. Ovo umanjenje se ne odnosi i na dodatne troškove prekršajnog postupka koji iznose 500 kuna.

Prijatelj mi je ovog ljeta, u jednoj dobro zaštićenoj uvali, od pomorske policije dobio prekršajni nalog s opisom prekršaja: Prilikom kontrole utvrđeno je da je isti usidren i istovremeno vezan na obalu. Time je navodno počinio prekršaj iz članka 133. Pomorskog zakonika i dobio kaznu od 3000 kuna, premda u tom članku takav prekršaj uopće nije opisan. Ne postoji nikakav zakon koji zabranjuje usidrenom plovilu da istovremeno bude vezano na obalu. U suprotnom, nitko tko plovilom ode u neku uvalu, na kupanje, na izlet ili obrađivati imanje, ne bi mogao iz svog plovila izići na obalu. Osim toga, plovilo vezivanjem uz obalu zauzima manje mjesta nego u slučaju slobodnog okretanja oko sidra, dakle, u uvali ima mjesta za više plovila, a u središnjem dijelu uvale i više prostora za manevriranje. Postojanjem takvog zakona bi se u nekim popularnim privezištima ili lukama, primjerice luka Hvar, plovila uz obalu mogla privezati isključivo bokom, što je nelogično, a s obzirom na otvorenost te luke za manja plovila i opasno.

Faktor sigurnosti

Jednako tako, nisu točna ni tumačenja da plovilo može biti privezano isključivo u luci ili dijelovima luke opremljenim napravama za privezivanje, premda Pravilnik o uvjetima i načinu održavanja reda u lukama i na ostalim dijelovima unutarnjih morskih voda i teritorijalnog mora RH, u stavku 1. članka 52., to propisuje. Naime, već sljedeći stavak, stavak 2., istog članka, a koji glasi: Iznimno od stavka 1. ovoga članka plovni objekt može biti privezan izvan luke isključivo na način da ne ugrožava sigurnost plovidbe, ljudske živote, imovinu, obalu i morski okoliš – to dozvoljava.

Dakle, plovilo može biti usidreno i istovremeno vezano na obalu, ali na način da ne ugrožava sigurnost plovidbe, o čemu govori i spomenuti članak 133. PZ-a prema kojem je vaš prijatelj kažnjen. Isti članak, pod istim brojem, bio je i u ranijem Pomorskom zakoniku, ali se po njemu ovakve prekršaje do sada nije kažnjavalo, vjerojatno jer ranije nisu bili ovako učestala pojava kao danas.

Problem se uglavnom javlja s većim plovilima koja se zbog svoga gaza ne mogu približiti bliže obali. Sidra su gotovo svima oborena s pramca, a približavanjem obali mogu ošteti kormila i propelere. Tako udaljeni od obale, a kako se ne bi okretali, jednim ili s više krmenih konopa se privežu za obalu, neki čak i dodatno po boku ili pramcu. Zvuči nevjerojatno, ali ponekad su ti konopi razvučeni i preko 50 metara. Ovakvo vezivanje čini zapreku i svakako ugrožava sigurnost plovidbe, naročito onima koji zaplove između njih i obale ili u uvalu i uz obalu uplovljavaju noću.

Mogućnost žalbe

Pravilo koje brani sidrenje uz vezivanje na obalu ne postoji, ali ovo o ugrožavanju sigurnosti plovidbe svakako da. Slijedom toga nema ni pravila koje definira koliko tako vezano plovilo može biti udaljeno od obale, već je to stvar zdravog razuma i slobodne procjene. Uzrok ovom nesporazumu vjerojatno je način na koji je prekršaj opisan. Možda bi bilo bolje da je još dopisano …čime ugrožava sigurnost plovidbe. Ukoliko je vaš prijatelj mišljenja kako nije ugrozio sigurnost plovidbe, tada je trebao to navesti u prekršajnom postupku i osigurati dokaze za koje smatra da je u pravu, pa prema navedenom u roku 8 dana nadležnom sudu uložiti prigovor.

Inače, novčana kazna predviđena za ovaj prekršaj iznosi od 3000 do 50.000 kuna, a ako se plati u roku 8 dana tada je umanjena na 2/3 izrečenog iznosa. Ovo umanjenje se ne odnosi i na dodatne troškove prekršajnog postupka koji iznose 500 kuna.

Prijatelj mi je ovog ljeta, u jednoj dobro zaštićenoj uvali, od pomorske policije dobio prekršajni nalog s opisom prekršaja: Prilikom kontrole utvrđeno je da je isti usidren i istovremeno vezan na obalu. Time je navodno počinio prekršaj iz članka 133. Pomorskog zakonika i dobio kaznu od 3000 kuna, premda u tom članku takav prekršaj uopće nije opisan. Osim toga, nije mi jasno kako se to bez sidrenja uopće može privezati uz neuređenu obalu. Aljoša G., Zagreb

 

Ne postoji nikakav zakon koji zabranjuje usidrenom plovilu da istovremeno bude vezano na obalu. U suprotnom, nitko tko plovilom ode u neku uvalu, na kupanje, na izlet ili obrađivati imanje, ne bi mogao iz svog plovila izići na obalu. Osim toga, plovilo vezivanjem uz obalu zauzima manje mjesta nego u slučaju slobodnog o...
